Saman AES Dibatalkan Kerana Perjanjian Itu Berat Sebelah- Menteri Pengangkutan

Jumaat lalu, tindakan kerajaan membatalkan semua saman AES berjumlah 3.1 juta membabitkan nilai RM435 juta yang belum dibayar sejak AES dilaksanakan pada 2012 menimbulkan pelbagai reaksi.


Susulan itu, Menteri Pengangkutan, Anthony Loke Siew Fook tampil memberi penjelasan dalam satu sidang media yang diadakan di Putrajaya semalam, lapor Malay Mail.

Menurut Anthony Loke, keputusan pembatalan itu diambil kerajaan adalah disebabkan perjanjian berat sebelah antara kerajaan terdahulu dengan dua syarikat konsesi yang mengendalikan sistem itu.

Jelasnya, tiada sebarang keuntungan daripada kutipan saman diperoleh kerajaan sebaliknya ia dibayar sepenuhnya kepada dua syarikat konsesi itu iaitu Beta Tegap Sdn Bhd dan ATES Sdn Bhd.


“Berdasarkan perjanjian, dua syarikat berkenaan berhak mendapat dua tier bayaran daripada kerajaan iaitu RM16 untuk setiap saman dan tier kedua adalah 50 peratus dari nilai sebenar saman RM300."

Tegasnya, kerajaan tidak bersetuju penguatkuasaan diswastakan kepada dua syarikat konsesi berkenaan, maka mengambil keputusan semua saman tertunggak itu dibatalkan.- CARI

Loke: Unpaid AES summonses would not have benefited Government

PUTRAJAYA: The RM435mil in unpaid Automated Enforcement System (AES) summonses would not have benefited the government,as the collection would have gone to two concessionaires instead, said Transport Minister Anthony Loke.

He said the agreement formed by the previous government with the concessionaires was so “lopsided” that the two firms would easily get a profit and a return of their investments.

“The collection would go to the two companies operating the AES, due to the lopsided agreement made with the previous government in 2012,” said Loke at a press conference held at his ministry on Monday (Aug 20).

He said there were two tiers in the agreement with the operators, adding that under the first tier, the government paying RM16 to the operators for every single summons issued regardless of whether the summons is paid.

“In 2012, 312,587 summonses were issued. For that, the operators earned RM5,001,392 from the RM16 payment.  However, only 23,640 summonses out of the total have been settled,” Loke explained.

He said that under the second tier, the companies would receive 50% out of RM300, for every summons that has been paid, adding that from the 23,640 summonses that were paid, the two companies earned RM1,045,304 in 2012.

Loke added that in 2016, the previous government reduced the AES summonses to RM150 from RM300.

“As the agreement for Tier 2 was that the company will receive 50% out of RM300 for summonses that are paid, that means, after 2016 any sum paid for summonses will fully go to the two operators.

“That’s why it is better to cancel the unpaid summonses,” said Loke.

The minister said the two companies, Syarikat ATES Sdn Bhd and Beta Tegap Sdn Bhd, have so far raked RM129,097,436 from the Tier 1 and Tier 2 payments.

“In 2015, the government instructed LTAT (Lembaga Tabung Angkatan Tentera) to take over the two companies. The government used  RM555mil of LTAT’s money as compensation to the two companies.

Loke said that the assets belonging to the companies was  only 47 speed cameras in the country, of which only 38 are operational.

He added that the cost of one camera is about RM250,000, which meant that the companies invested just over RM10mil to install the 47 cameras.

“The companies not only easily got a return of their investments, but profited after that," said Loke.

KUALA LUMPUR (Bernama): The National Patriots Association (Patriot) is demanding a full investigation over an alleged lopsided agreement between the previous government and two concessionaire companies of the Automated Enforcement System (AES).

Its president Datuk Mohd Arshad Raji said the Malaysian Anti-Corruption Commission (MACC) and police should immediately take action over recent reports that the Armed Forces Fund Board (LTAT) had been instructed by the previous government to use its funds to pay RM555mil to the two companies to take over the AES.

"Patriot demands to know who the corporate owners of the two AES concessionaire are, namely ATES and Beta Tegap. Why did the managing director and the board of directors of LTAT allow the RM555mil to be taken from the fund?" he asked in a statement on Sunday (Aug 19).

Transport Minister Anthony Loke on Friday (Aug 17) revealed that RM295 million paid to ATES Sdn Bhd and RM260 million to Beta Tegap Sdn Bhd did not involve taking over a large number of assets but only 40 AES cameras.

He also said that LTAT had acted on the instructions of the Barisan Nasional government.

Mohd Arshad said the use of LTAT funds in this manner was tantamount to criminal breach of trust as the fund was set up primarily to take care of the welfare and retirement benefits for servicemen.

ada ketikanya membazir jika kerajaan beli

inisiatif awam swasta ada banyak kelebihan

sepatutnya loke hanya perlu kemaskan prosedur
jika itu yang kurang

kamera milik konsesi cina atau melayu, mengapa perlu batalkan saman?

sedangkan kesalahan dah pun berlaku tak kira bangsa apa
yang miliki syarikat

Pembayar saman AES......terpaksa ration perbelanjaan sebab nak bayar saman.
