Dr M drags Najib to court, seeks RM2.6b in damages

KUALA LUMPUR, March 23 — Senior Umno leader Tengku Razaleigh Hamzah today said it was Tun Dr Mahathir Mohamad’s right as a taxpayer to sue Prime Minister Datuk Seri Najib Razak.
The Kota Baru MP said any taxpayer was entitled to take legal action if he felt aggrieved by a public official’s negligence or abuse.
“Anyone can sue ministers and public officials if they are not carrying out their responsibilities properly, such as if there was a misuse of power. We as ordinary citizens can sue. They are subject to legal action,” Tengku Razaleigh responded when asked at the Dewan Rakyat lobby.
“As long as a person pays taxes, they have the right. They would have local standi.”
Dr Mahathir today filed a lawsuit against Najib for alleged interference in government investigations on 1Malaysia Development Berhad (1MDB) and the RM2.6 billion political donation.
Two others who filed the lawsuit at the Kuala Lumpur High Court are Datuk Seri Khairuddin Abu Hassan and Anina Saadudin, two former Umno members who earlier this month signed the “Citizens’ Declaration” along with Dr Mahathir and 42 others to seek Najib’s resignation as the prime minister.
Among others, they are seeking for the court to order Najib to pay exemplary damages of RM2.6 billion and aggravated damages of RM42 million to the government of Malaysia, although they said the exact sum will be left to the court to assess.
On January 26, Attorney-General Tan Sri Mohamed Apandi Ali cleared Najib of any wrongdoing in the corruption probes on former 1MDB subsidiary SRC International Sdn Bhd, and the transfer of an alleged RM2.6 billion donation into the prime minister’s private accounts.

KUALA LUMPUR, March 23 — Tun Dr Mahathir Mohamad has no legal standing to sue Datuk Seri Najib Razak over the RM2.6 billion political donation controversy as the prime minister’s receipt of the sum did not harm the former in any way, Datuk Nur Jazlan Mohamed said.
The deputy home minister agreed that it was for the courts to decide whether Dr Mahathir has “locus standi” to sue Najib, but said it was likely the former prime minister was merely using the lawsuit to make a political statement.
“If you want to sue, you need to have locus standi. If you want to sue the prime minister as a private citizen, means there is no locus standi. The one that can sue is someone who feels he has been wronged.
“Let the courts decide but to me, he doesn’t have locus standi. What he is doing as a political gimmick only,” he told reporters at the lobby of the Dewan Rakyat today.
“Locus standi” is a legal Latin term which translates to “place to stand”, which refers to whether a party has a right to be heard in court.
Dr Mahathir today sued Najib for alleged interference in government investigations on 1Malaysia Development Berhad (1MDB) and the RM2.6 billion political donation.
In the lawsuit filed against Najib for alleged misuse of power and breach of duty, Dr Mahathir claimed that the prime minister had taken steps to impede investigations on the two controversies.
This is the first lawsuit against Najib by Dr Mahathir, Malaysia’s longest serving former prime minister who has been leading a campaign calling for the former’s removal over alleged financial irregularities.

peguam 1mdb = peguam negara
peguam madey = wak komidi/ amat maslan (tuan hakim tentukan)
so, sebarang maklumat madey bleh la serah pada wak komidi
untuk diuruskan.

Zaman Dr M dulu, kerajaan terpelihara daripada public interest litigation ni. Cuba tgk kes Lim Kit Siang saman UEM dulu dgn menuduh bahawa Umno ada kepentingan dalam highway concession. Walaupun LKS kata dia MP, ketua pembangkang, pembayar cukai dll, takdenya locus standi. Kes Razak Ahmad lawan kerajaan Johor pun sama. Kes Kajing Tubek dgn penduduk2 lain lawan kes Bakun dulu pun sama. Undang2 locus standi kat Malaysia ni ketat bukan mcm kat UK atau beberapa negara lain yg dah berkembang ikut peredaran zaman. Kalau zaman Dr. M sbg PM, takde pun dia membantah kata pembayar cukai patutnya dpt standing dlm mahkamah utk menyaman kerajaan atau pemimpin atas nama kepentingan awam. Walau bagaimanapun, itu hal Dr M secara peribadi. Secara adilnya, mmg patut kita menyokong kes saman berdasarkan kepentingan awam ni mcm negara2 lain juga. |

Andainya kalah dah tentu dia xkan bayar balik. Kalah shj sudah cukup buat jwtn dia di tarik balik pastu collateral damage akan menunggu |
