kak glemer..sama2lah kita berdoa agar mati dalam beriman..amin...

hendak mati dlm beriman haruslah terlebih dahulu menjadi orang yg beriman.  Orang yg beriman akan menjaga lidahnya, berhati bila berkata2 dan berwaspada dlm berbahasa.  Orang yg beriman mengawal emosinya dan prasangkanya.

Karpal pledges his pro bono tudung case won't smell of politics
Maintains that Singapore tudung ban unconstitutional, discriminatory

by Patvinder Singh Feb 20, 2002 2:53pm

Lawyer Karpal Singh said today his representation of the couple challenging
in court the Singapore Government's tudung ban on schoolchildren has no
"political flavour."

He also pledged that his involvement won't interfere in the republic's
domestic issues.

"I assure the Singapore government, in particular Prime Minister Goh Chok
Tong, that my participation in the legal process will not in any way have
any political flavour or any interference in Singapore's domestic issues by
a foreigner," Karpal said in a statement.

Faroukh Dawood and Zulkifli Ali, fathers of girls affected by the ban,
had approached Karpal and two Singapore lawyers to take the case to court.

Karpal has promised to do the case pro bono.

Although he commented on the issue in his capacity as a DAP leader, Karpal
maintained that he had specifically spoken of the ban being
"unconstitutional and discriminatory."

"It is imperative that a judicial pronouncement be obtained on the issue
which is of public interest both in Malaysia and Singapore," he said.

Although there had been favourable court decisions in respect of wearing a
turban in school, both in Malaysia and the United Kingdom, Karpal said there
was no precedent in the Commonwealth in relation to the use of the tudung by
schoolgirls.

He referred to a recent ruling by the Madrid regional government in Spain
which overruled a director of a public secular school from disallowing a
Muslim Moroccan girl from wearing the hijab to school.

"In my view, having regard to this precedent at least, the Singapore
Government should be mature, realistic and pragmatic," he said, "and not
contravene its own Constitution which grants freedom of religion and outlawsdiscrimination."

Karpal reiterated that Sikh schoolboys in Singapore have not been prohibited
from wearing turbans.

"I see no reason why the tudung should be banned," he added.

Karpal to represent families suing Singapore Government
By Cheah Chor Sooi 20 Feb 2002

KUALA LUMPUR, Tues. - Lawyer Karpal Singh has agreed to represent two
families who are taking the Singapore Government to court over a ruling
banning the use of the tudung by their children in public schools.

He will also challenge the Singapore Education Ministry and three public
schools on the matter. Karpal said Singapore Muslim social activist Zulfikar
Mohamad Shariff, representing the families, had contacted him earlier this
month.

"Zulfikar met me just before the Chinese New Year and I have offered my
services to the families involved. But first, I must apply to the Singapore
High Court for permission to represent my clients," said Karpal who was
called to the Singapore Bar in 1991.

"I also hope that the Singapore Law Society will not object to my
representing their citizens. If everything proceeds smoothly, I will make a
trip to the republic in due course to file certain papers. I will do it pro
bono," he said.

He was commenting on a statement by Zulfikar that Faroukh Dawood and another
man, Zulkifli Ali, both fathers of children affected by the ban, had
approached him and two Singapore lawyers, Sadari Musari and Hussien Laitiff,
to take the case to court.

Farouk's daughter, Khairiah, was suspended from the Eunos Primary School on
Feb 11 for defying a ban on the use of the tudung. Zulkifli's daughter,
whose name is unavail able, had to leave a government school in 1998 when
she reached Secondary Two as she was not allowed to wear the tudung.

Siti Farwizah of the Chong Zheng Primary School in Tampines, Nurul Nasiha
Mohamed Nasser of White Sands Primary School in Pasir Ris and Siti Amirah
Amir of Yu Hua Primary School were also suspended for refusing to discard
the tudung.

The Associated Press quoted Zulfikar as saying that papers would be filed in
April to request a judicial review into whether or not the Singapore
Government, the Edu-cation Ministry and three public schools that suspended
the girls were "surpassing their scope" with the ban on the tudung.

"Some of the parents are keen to do it (take the case for judicial review)
because the ban is a violation of their rights," Zulfikar said, noting that
Singapore's ban on the tudung defied the Constitution and the Children's
Rights Convention, an international human rights treaty which Singapore had
signed.

"The families approached Karpal because he has experience with judicial
review and has agreed to try the case for free. Local lawyers qualified to
try the case refused to take it," Zulfikar told AP. At the height of the
controversy earlier this month, Karpal, who is also the DAP deputy chairman,
had urged the Singapore Government not to be insensitive to the rights and
feelings of its Muslim citizens although it had the right to implement
domestic policies in the republic. Joining the chorus of protests from the
Umno and Pas Youth movements, Karpal had said he believed racial harmony in
the republic would be enhanced if the ruling was revoked.

"I would have thought the Singa-pore Government would have been more mature
than descend to im-plementing a ruling defying logic and common sense.

"Sikh pupils in Singapore schools are allowed to wear turbans. Why the
discrimination?"
