[Aduan] BAGI PENDAPAT GUYS. NAK TUNTUT GAJI DARIPADA MAJIKAN (RETRENCHMENT EDITION - COM

aku nak mintak pendapat korang. sama ada korangpernah experienced, atau arif bab ni, mintak tolong bagi pendapat.
aku kena retrenched by company masa bulan Julai2020 haritu. company bagi surat berhenti dengan notis satu bulan. masadipanggil masuk dalam meeting room tu, memang tak expect pun akan kenaretrench. alasan diorang sebab covid lah (alasan paling relevan buat masa ni).nak minimize manpower. bila dah duduk, and diorang (HR) bagitahu aku kenaretrench, terkejut jugak. terkejut bercampur risau sebab dah fikir lepas nimacam mana nak survive apa semua. masa tu HR manager tu explain la apa yang akuakan dapat. company bagi pampasan (dikira ikut formula yang termaktub dalamakta buruh), annual leave yang tak digunakan tu company akan reimburse, dangaji sebulan (sebab aku still bekerja dan notis sebulan diorang bagi tu, akumasih kena bekerja). and dia bagi masa kat kitorang (bukan aku sorang kena. adalagi 8 orang kena retrench) 24 jam untuk sign surat tu dan bagi balik copy ofsigned termination letter. and yes, kitorang sign surat tu. aku masa tu stillin shock and tak boleh nak fikir apa-apa lagi selain "what will happen tome in future?". so aku sign je and return balik copy.
lepas 1 minggu macam tu, barulah aku rasa calm, danboleh terima kenyataan yang aku dah jobless, dan masa tengah duk termenung tuaku compare balik apa yang HR bagi according to termination letter tu, dan apayang termaktub dalam offer letter. and baru aku perasan kat dalam offer letterada menyatakan yang kalau nak terminate staff, company kena bagi 3 months oftermination notice. so kat situ dah nampak yang benda ni tak tally. so aku puntanya lah elok-elok kat akak HR manager tu balik,
aku: kak, kenapa dalam surat terminate company baginotice sebulan je? bukan kena bagi notice 3 bulan ke?
akak HR: kan akak ada bagi amended offer letterdulu. ada banyak benda yang company amend. kan akak ada buat conference call.check balik dengan manager awak.
aku: tapi saya takde sign apa-apa offer letter yangbaru pun
akak: memang tak ada offer letter baru.
aikk?!
so conversation tu mati kat situ. aku dan stafflain ada juga request dia bagi softcopy offer letter yang disebutkan tapi akakHR tu boolayan. masa ni kitorang semua dah lepas daripada tempoh bekerja dalamcompany tu. agaknya diorang serabut kitorang semua duk bising-bising nak mintakoffer letter, dia call (email langsung tak reply, call boleh pulak) kami semuasorang demi sorang untuk bagitahu yang diorang tak boleh bagi offer letter tusebab kami semua no longer the company's staff. haha. aku tahu hardcopy offerletter semua staff simpan kat mana. so aku mintak staff (yang rapat dan palingboleh dipercayai) kat outlet tu tolong cari dan snap gambar. TAPI, tiba-tibafile tu dan GHAIB. haha. berbulan-bulan duk sadai kat situ, tapi kali nitiba-tiba boleh lenyap.
actually kitorang ada je offer letter tu (softcopy)tapi saja je nak mintak kot kot memang ada yang dia kata 'amended banyak bendatu'. tapi takde. bukan kitorang je yang takde letter yang baru, tapi SEMUASTAFF memang takde offer letter baru yang akak tu gembar-gemburkan.
masa tengah kecoh pasal isu offer letter, tiba-tibacompany call sorang demi sorang datang ke HQ untuk sign surat baru.
siap keluarkan memo lagi dan semua kena sign.
so dalam hal ni, boleh tak fight kat pejabat buruh untuk tuntut gajilagi 2 bulan tu? mohon pendapat guys.

cuba je rujuk jabatan buruh atau IR..
sebenarnya HR ade hak utk berhentikan serta merta dgn tanpa bayar notice in lieu..
asalkan dia kene buktikan syarikat rugi dan kene kurangkan pekerja serta merta..
pekerja pon kene hati2 masa sign surat baru..

Yeap agree. Pergi pejabat buruh. My advice ni you Kena collectively kumpul semua orang punya stand(batch Yang Kena buang dgn you).

But I Rasa you boleh argue dgn point bad faith. Siap bagi letter last2 Tu utk disign.

Sebenarnya mmg kdg2 company boleh ubah terms and conditions of the original contract of employment but Kena dapat consent employee dulu, ie any form of acknowledgement.
