Hanya yg kureng cerdik duk ingat kerajaan yg lantik TPM yg ada kes mahkamah boleh naikkan ekonomi negara. Dah sah2 although legally right to appoint wak tut, tapi tindakkan tu ethically wrong. Kalo etika pun hancur, agak2 apa sentimen pelabur kat Malaysia?
Tambah plak dgn MOU yg legally wrong ni lagik. Rasanya what will be the sentiment?

KUALA LUMPUR: Two-term Pasir Gudang member of parliament Hassan Abdul Karim has expressed disappointment with the memorandum of understanding (MoU) signed by coalitions supporting the unity government, particularly the clause that prohibits MPs from voting based on their conscience in Parliament.
The senior Johor PKR leader, a loyalist of Prime Minister Datuk Seri Anwar Ibrahim, said the signing of the MoU was a death knell for the parliamentary privileges and rights of representatives elected by the people, who did not expect that their MPs would be told what to do in Parliament.
He said though he disagreed with the clause, he would support the prime minister in tomorrow's vote of confidence in the Dewan Rakyat.
He said this was not only because Anwar was his friend and comrade-in-arms in the Reformasi movement, but also because he was confident Anwar would bring political and economic stability.
"I will vote on all matters in the Dewan Rakyat according to my conscience.
"Prohibiting me from deciding what is best for the rakyat is a violation (of my rights).
"As for the confidence vote, I will vote in favour of Anwar as he is the best man for the job," Free Malaysia Today quoted him as saying.
Leaders of five coalitions signed the MoU on Friday in support of the unity government led by Anwar.
Anwar had said he would test his "majority support" in the Dewan Rakyat tomorrow through a vote of confidence.
One of the clauses in the MoU stipulates that MPs who fail to toe the line set by their parties and vote against the prime minister or the government would be deemed to have resigned as MPs.
The clause said these MPs' seats would then be considered as vacated under Article 49A(1) of the Federal Constitution.
Hassan, a lawyer who began his career in politics with Parti Rakyat Malaysia, said he joined PKR after Anwar was sacked as deputy prime minister by then prime minister Tun Dr Mahathir Mohamad in 1998 to reform the country's politics, which he considered to be authoritarian in nature.
"This is why I am against the MoU as it seems authoritarian. It curtails the freedom of choice guaranteed in the Federal Constitution.
"I am against any move that appears to take our parliamentary democracy several steps backwards."

sape suruh korang tak undi HARAPAN masa pru haritu..pecaya sgt dgn fitnah2 PN/Pas smpai PH gagal dpt majoroti mudah 112 kerusi utk bentuk kjan..so hadap je la kecacamerbaan kjaan campuran ni sampai kena buat mou bagai utk jadi kjaan stabil..

kalau kjaan skrg 100% kjaan HARAPAN semua ni takkan jadi..agenda reformasi akn berjalan lancar,zahid hamidi takkan jadi tpm dan lantik org2 dia as lantikan politik bagai..

so baik atau buruk kjaan campuran ka,kjaan minoriti ka hadap je lah tak payah nak banyak bunyi.sape suruh gatal x undi PH

dalam sistem demokrasi tiada paksaan sokong PM hingga lucut status MP camtu, rakyat bagi undi kemudian dia pi lucut plak lepaih tu hanya kerana tak sokong dia je , makna dia override keputusan rakyat ler so automatik demokrasi tak wujud lah jawabnya
Tapi sapa yg nak boleh tangkap dia walau dia ternyata dah menghalang demokrasi ?

bawah ni plak sebut klausa tu memang tak berpelembagaan dan membawa ke arah pemerintahan kuku besi aka absolute dictatorship, tarak dalam perlembagaan yg membenarkan parti atau individu paksa MP utk sokong pepe usul ler diparlimen , walau kluasa tu melanggar akta melanggar undang2 tapi dia kata MOU tu still berperlembagaan sebab bab2 lain dalam MOU tu tak langgar perlembagaan,  so dia syorkan utk celen klausa tu di mahkamah

DECEMBER 19 — Two days ago, the coalition in the national unity government signed a memorandum of understanding pledging to support Datuk Seri Anwar Ibrahim’s administration in all matters of confidence and supply, guaranteeing its stability.

The agreement that was signed by the coalition has raised a questionable legal issue in clause 4b which states :

The above clause simply means that an MP who does not vote along with his or her party is deemed to have resigned and ceases to hold the position as a member of Parliament, and his seat will deemed vacant according to Article 49(A)(1) of the Federal Constitution.

It is humbly submitted that the clause violates one’s freedom of right under Article 10 of the constitution. This is because the right to vote falls under an individual rights, and is something that the party as a collective cannot compel someone to vote along party line.
Such clause tends towards an absolute dictatorship when MP’s are not given their rights to vote freely, and this would give a wrong perception to the public.
As such, clause 4(b) of the agreement goes against the spirit of Article 49A which is unconstitutional. This is because Article 49A itself does not disqualify the MP’s on this basis.
Be that as may be, the true meaning and purport of Article 49A will only be known if the clause is challenged in court.
Nonetheless, one invalid clause does not effect the other clauses in the agreement. The agreement can be said to be constitutional.

Rafizi Ramli, menyifatkan MoU Perjanjian Persefahaman Kerjasama sebagai ‘lebih demokratik’ berbanding pemerintahan sebelum itu, termasuk pentadbiran PN.
PETALING JAYA: Semua Ahli Parlimen dari parti menyokong kerajaan perpaduan bebas mengundi berdasarkan pandangan masing-masing, kecuali dalam perkara berkaitan keabsahan kerajaan, tegas Timbalan Presiden PKR Rafizi Ramli.
Beliau yang juga menteri ekonomi, berkata antara undian berkait keabsahan kerajaan termasuk usul undi percaya terhadap perdana menteri dan undian perbekalan.
Sebenarnya 148 Ahli Parlimen yang menyokong kerajaan perpaduan Malaysia ini adalah bebas untuk mengundi mengikut kepakaran dan pandangan sendiri.
Kecuali dalam perkara berkaitan keabsahan kerajaan seperti yang termaktub di bawah Perlembagaan Malaysia dan Akta Lompat-Parti. Itu memang undang-undang pun. Dan itu tidak tertakluk dalam fasa empat dalam perjanjian ini,” katanya menerusi rakaman video di Tiktok.



Tambahnya, perjanjian dimeterai itu jauh lebih demokratik berbanding pemerintahan sebelum itu, termasuk ketika pentadbiran Perikatan Nasional (PN) pimpinan Muhyiddin Yassin.
“Ketika Muhyiddin pimpin dahulu, apabila nampak dia sudah hilang majoriti dia menggunakan kuasa darurat untuk memerintah tanpa cuba untuk mengesahkan sokongan majoriti di Parlimen pun.
“Agak lawak satu reaksinya daripada pertikaian PN kononnya perjanjian yang dimeterai suatu langkah ke arah kewujudan ‘diktator’ di bawah pemerintahan Perdana Menteri Anwar Ibrahim,” katanya.

Semalam, bekas timbalan menteri di Jabatan Perdana Menteri (parlimen dan undang-undang), Mas Ermieyati Samsudin, mengecam memorandum persefahaman (MoU) Perjanjian Persefahaman Kerjasama menyokong kerajaan perpaduan diterajui Anwar.
Beliau menyifatkannya sebagai satu permulaan kepada pemerintahan ‘ala diktator’.
Tambahnya, Perlembagaan Persekutuan memberi kebebasan mutlak kepada mana-mana Ahli Parlimen yang telah dipilih untuk mengundi sebagaimana dirasakan betul demi kepentingan pengundi.
Selain Anwar, MoU semalam itu turut ditandatangani Pengerusi Barisan Nasional (BN) Ahmad Zahid Hamidi, Pengerusi Gabungan Parti Sarawak (GPS) Abang Johari Openg, Pengerusi Gabungan Rakyat Sabah (GRS) Hajiji Noor dan Presiden Warisan Shafie Apdal. Ia juga ditandatangani oleh setiausaha agung parti masing-masing.

KUALA LUMPUR, Dec 19 — Clause 4 in the unity government’s memorandum of understanding (MoU) poses a legal problem, as it seems to go against the intention of the anti-party hopping provision in the Federal Constitution, the Malaysian Bar said.
Its president Karen Cheah Yee Lynn highlighted the Bar’s “great concern” over Clause 4 of the MoU or memorandum of agreement (MoA), which could result in MPs losing their seats if they choose not to vote in favour of parliamentary motions that may affect the unity government's legitimacy.

Among other things, Clause 4 requires all political parties who had signed it to vote to support the prime minister in votes of confidence and other matters that would affect the unity government's legitimacy, and to also ensure their MPs vote in favour of such matters.
The same clause also states that failure, refusal or negligence by such political parties’ MPs to vote in support of the unity government would be considered as the MP's breach of individual responsibility to the party, and would be deemed as such an MP having resigned or ceasing to be an MP within the framework of Article 49A(1) of the Federal Constitution. This will then trigger a by-election.

But the Malaysian Bar said this clause in the unity government's MoU goes beyond what the anti-hopping law in Article 49A was intended to cover.

“Through an in-depth reading and analysis of Clause 4 of the MoA, this clause appears to be directly averse to the intention and wordings of Article 49A of the Federal Constitution,” Cheah said in the statement issued late last night.
Under Article 49A(1) of the Federal Constitution, an MP will no longer be an MP and his seat will become vacant, if he resigns from or ceases to be a member of the political party which he belonged to when he was voted in as MP.
In other words, this will result in a by-election.
Article 49A is a new amendment to the Federal Constitution to overcome the problem of political instability and collapse in governments when MPs jump to different parties. It received royal assent on August 31 and was gazetted as law on September 6.
The Malaysian Bar suggested that Clause 4 appears to be based on internal party processes if any MP does not vote in favour of parliamentary motions that affect the unity government's legitimacy.
It suggested this means there would be an internal enquiry and due process before a notice of the MP's seat becoming vacant can be issued to the Dewan Rakyat Speaker — which would then trigger a by-election.
The Malaysian Bar said the mention of the resignation or even possible expulsion of such MPs is “where the problem lies”.
Cheah pointed out that the Malaysian Bar had previously raised the concern — before the Federal Constitution was amended to introduce Article 49A as an anti-hopping law — of the possible abuses that could arise.
“What if political parties engineer a way to put in place a resignation process or expulsion process within their own constitution that would circumnavigate due process?” she asked when illustrating such possible abuses of the law.
As political parties could potentially change their own party constitution to bypass the proper process that should be undertaken before causing non-compliant MPs to lose their seats, Cheah said anti-party hopping laws should enable MPs to be able to go to court to seek for court decisions on whether their parties were justified in treating the MPs as having resigned or no longer being a party member.
“Shouldn’t the AHL include provisos to include that such resignations and expulsions should not be automatic but be postponed and subject to the MPs having sufficient legal redress through the court of law to adjudicate on the justifiability of such calls made by the political parties?” she said, referring to the anti-hopping law.
Cheah suggested that political parties who had signed the MoU would be considered to have agreed that Clause 4 would apply to them and their MPs, unless they voice their disagreement with said clause.
“As a matter of good governance, the Malaysian Bar expects that the MoA was signed by the political parties in which MPs from these parties would have been consulted and agreed to the phrasing of Clause 4 of the MoA. Until they disagree, we accept that the component of political parties and MPs within them would have accepted to be bound by MoU including Clause 4,” she said.

Today is exactly one month after the 15th general election and MPs are expected to vote on whether they have confidence in Pakatan Harapan chairman and PKR president Datuk Seri Anwar Ibrahim to be prime minister.
