selebihnya dia akan pulangkan kepada buyer
lagipun u blum sign s&p lagi kan?

Pada pandangan Merak yg rabun2 sket ni.......1k tu considered as earnest deposit. Pada kebiasaannya bila kta beli property dr developer dan byr 1k cthnya, developer akn bg satu statutory declaration (SD) atau apa2 jua surat akuan yd perlu ditanda tangani oleh pembeli. Dlm SD tu akn dinyatakn sekiranya pembeli tidak membayar baki deposit dlm tempoh tertentu (biasanya 30hr) dr tarikh bayaran earnest deposit atau berhasrat tidak mahu membeli harta tersebut atas apa jua alasan maka 1k yg dibyr tidak akn dipulangkan. 30days grace period yg diberi tu adalah bg tujuan pembeli withdraw KWSP utk menjelaskn baki deposit.
Ms byr tu ada sign tak? atau pn pemaju ada explain tak?klu ada hitam putih sng.

Pada pandangan Merak klu da sign S&P:
Ada 2 situasi:
1-Loan Lulus
Sekiranya kita da byr deposit then loan lulus tp kita xjd teruskan pembelian atas apa jua alasan sekalipun , ada clausa dlm S&P tu menyatakn deposit forfeited,xder cara nk dpt blk.
2-Loan x Lulus
Dalam keadaan ini klu kita da byr deposit tp loan x approved maka pemaju perlu refund deposit.
**Seterusnya perlu buat revocation agreement utk batalkan S&P, kos ditanggung oleh pembeli. |

klu mcm kes i ni..masa byr 1k tu ada sign...lps tu sign S&P yg dihantar oleh lawyer.then hntr form utk kelulusan..tup tap x lulus atas sbb i prnh bt pinjaman utk kete.so masa tu la i stop utk meneruskn niat beli umh.masa belum sign S&P i dh byr kt loyer dlm 500>..then nk batal pun kne byr lg 400>. |

Ok loan x lulus...cb u baca apa y u sign tu ada sebut tak klu loan x dpt 1k tu pulang.Pd kebiasaannya xkn refund. Yg akn refund spt dlm clause loan dlm agreemnt tu ialah deposit & bkn earnest dep/booking fee.
Bayaran RM500 pd lawyer sbg deposit legal cost & disbursement..biasanya klu xjd beli (selain drp sbb saja2 nk batalkn) lawyer kena pulangkn setelah tolak kos stamping S&P RM40 (klu ada deed of mutual covenants/ikatan waad-waad bersalingan iaitu bg harta tiada geran biasanya utk rmh yg tinggi2 tu kos tambah lg RM40) dan peparation agreement,biasa utk preparation lawyer ambil M100 shj..depends pd lawyer.
RM400 tu utk kos revocation S&P..merangkumi RM300 legal fees, 5% tax, RM40 stamping & RM50 miscellaneous. Ni mmg pembeli kena tanggung kos.

2. Stamping SPA RM 40
3. Stamp Duty om Transfer (estimate) RM 547
4. Land search charges RM 60
5. Registration consent to tranfer &
charge RM 60
6. Registration MOT RM 100
7. Transport RM 150
8. Photostating, Printing & Incidental
charge RM 50
9. Miscellaneous:tel,fax & courier RM 50
total RM 1094.00

Tu total charges utk disbursement.Klu u da sign & stamping S&P, lawyer akn ambil item no 2, 8 & 9 (klu beli direct developer). Klu u beli atas tgn maka item no 4 lawyer akn ambil RM30shj, yg lain kene refund. P la tanya knp depa xrefund yg balance utk perbelanjaan yg x digunakan.Setiap duit utk disbursement yg lawyer guna ada receipt, cb minta tgk. |
