Amin - CARI Infonet

This is not about Pakcik Zul, this is about an outdated provision in the Penal Code (s. 99) that runs counter to the common sense i.e. that a man is entitled to protect himself and his family against any intruder into his dwelling, at whatever costs to the intruder. The intruder has no business breaking in into anybody's home in the first place. An intruder breaking in into a house will not come empty handed and unprepared. And yet our version of the "castle law/doctrine" requires us to exercise restraint (i.e. to retreat/run away from the intruder if exercise of self defense will result in death to the intruder). I think it is about time that we amend the law. Take the harsher end of the castle doctrine that allows, what William Blackstone in his Commentaries on the Laws of England proclaims as "the natural right of killing the aggressor (the burglar)" (in some part of the US this is known as "stand your ground" doctrine that removes the duty to retreat first before lethal force can be used against the intruder). Assuming pakcik Zul is within his rights to self defense, but found culpable for murder for transgressing those rights, how many cases like Pakcik zul's do we need before we realize that an intruder to a man's home deserves no courtesy nor mercy? For justice sake, the time has came for the law to be amended, if not it could as well be a Magna Carta for rapists, burglars and murderers to break into our home. Let us make Malaysia safe again.
