Tun Zaki Azmi appointed as judge at Dubai financial courts
KUALA LUMPUR: Former Chief Justice of Malaysia Tun Zaki Azmi has been appointed as a judge at the Dubai International Financial Centre (DIFC) Courts.Zaki was sworn in on Dec 10 in Dubai along with Justice Shamlan Al Sawalehi from the United Arab Emirates (UAE) and Roger Giles, Queen’s Counsel, from Australia.
When contacted, Zaki said it was an honour to be appointed by Sheikh Mohammed Rashid Al Maktoum, the Prime Minister of UAE and Ruler of Dubai, and expressed his gratitude for the ruler’s trust in appointing him.
“I believe a Malaysian was chosen because they recognised the judicial integrity of Malaysian judges.
“God willing, my role will allow me to contribute and deliver my best for the benefit of the DIFC Courts specially and to the Emirates generally.”
Zaki is the second Malaysian to serve in the DIFC Courts.
The first was Tan Sri Siti Norma Yaakob in 2008, after her retirement as Chief Judge of Malaya in 2007.
Siti Norma, who was with the DIFC Courts until this year was the first female judge appointed to the Courts.
According to the DIFC website, the DIFC Courts is independent judicial system within the financial district.
It operates a “common law judicial system with exclusive jurisdiction over all civil and commercial disputes within DIFC financial district, including bodies and companies registered in DIFC.”
The courts, which have a panel comprising internationally renowned commercial and civil law judges, work to ensure the highest standards of legal procedure “so that they provide the certainty, flexibility and efficiency expected by global institutions operating within DIFC.”

Controversy[edit]

On November 7, 2008 Chief Justice Tan Sri Zaki Azmi made the announcement that two retired judges were suspected to be corrupt. He said he knew them personally but did not take action against them.[6]

Further to this, there has been strong links between Tun Zaki Azmi and the government of Malaysia which would have signaled a conflict of interest should he become the Chief Justice of Malaysia.

Recently, it was revealed that a company linked to former chief justice Tun Zaki Azmi and Umno lawyer Hafarizam Harun may have been given the concession for the Kinrara-Damansara Exchange (Kidex), a road project awarded by the government.

The award of the contract was purportedly made by the government just before the CJ retired. His wife is the shareholder of the company that is said to have been awarded the lucrative contract valued at RM2.2 billion.[7]

Before his retirement in September 2011, the Judges’ Remuneration Act (JRA) 1971 was amended to allow a chief justice, president or chief judge to claim for maximum pension after holding the office for more than three years. Previously, the provision required a chief justice to also serve a total of 10 years as a judge, out of which, three years must be spent holding the position of chief justice, president or chief judge.

Opposition lawmaker Lim Kit Siang as well as some lawyers alleged that the amendment was made for the sole benefit of Zaki Azmi.[8] Zaki had spent less than five years as a judge but more than three years in aggregate as president of the court of appeal and as chief justice.

Tahniah Tun Zaki. Ini satu penghormatan yang amat tinggi juga bagi Malaysia.  Bapaknya Tun Azmi pon dulu Lord President. Bank kata orang ke mana tumpahnya kuah kalau tidak ke nasi.
