Budak jadi saksi beri keterangan dilindungi

SAKSI kanak-kanak boleh memberi keterangan menerusi rakaman video dan siaran langsung kepada mahkamah, manakala penghadang akan dipasang dalam kamar bagi mengelak mereka dilihat tertuduh jika memberi keterangan di mahkamah.

Kedua-dua langkah itu antara peruntukan Rang Undang-Undang Keterangan Saksi Kanak-Kanak 2007 yang dibentangkan, semalam.

Menteri di Jabatan Perdana Menteri, Datuk Seri Nazri Aziz ketika membentangkannya berkata, peruntukan itu bagi mewujudkan ruang sesuai kepada saksi kanak-kanak, khususnya mangsa memberikan keterangan.

"Ada antara mereka mengalami trauma kerana menjadi mangsa pelbagai jenayah. Jadi, mereka perlu diberi peluang memberi keterangan dalam keadaan selesa," katanya.

Saksi kanak-kanak adalah mereka yang berusia bawah umur 16 tahun.

Nazri berkata, saksi kanak-kanak boleh memberi keterangan dengan memilih sama ada mengadakan penghadang dengan tertuduh, secara langsung atau rakaman video atau gabungan mana-mana daripadanya.

Bagaimanapun, keterangan melalui rakaman video terhad kepada keterangan yang diberi dalam pemeriksaan utama dan disifatkan keterangan dalam mahkamah terbuka.

PUTRAJAYA: Having set aside the sentence that a boy be detained in prison at the pleasure of the King in a landmark judgment last week, the Court of Appeal now wants to see if he can be sent to prison for natural life for killing his tuition teacher抯 daughter five years ago.

Court of Appeal Justice Gopal Sri Ram ordered DPP Yaacob Sam yesterday to look into whether the laws of England were applicable in Malaysia to sentence a teenager to natural life for murder.

The judge instructed the prosecutor to find out if the appellate court could 搃mport Section 5 of the Criminal Procedure Code (CPC) and send the 17-year-old boy to prison.

PUTRAJAYA:  The Court of Appeal has ordered the release of the 17-year-old boy convicted of murdering his tuition teacher抯 11-year-old daughter five years ago.

When setting aside the sentence that the boy be detained in prison at the pleasure of the King in a landmark judgment earlier this month, Court of Appeal Justice Gopal Sri Ram had ordered DPP Yaacob Sam to look into whether the laws of England were applicable in Malaysia to sentence a teenager to natural life for murder.

The Court met Wednesday to hear submissions from the DPP and defence counsel on whether the appellate court could 搃mport Section 5 of the Criminal Procedure Code (CPC) and send the 17-year-old boy to prison.

Youths languishing in prison for minor offences

KUALA LUMPUR: A 19-year-old youth from Sabah has been languishing in prison for six months because his single mother is unable to post the court bail of RM1,000.  

For his offence of not carrying his MyKad, Jeff Lee Kwong Yeung faces a fine of between RM3,000 and RM20,000 but his case has been postponed several times since he was first charged in court on Feb 5.

To complicate matters, the MyKad number Jeff gave was found to belong to someone else and his fingerprints are being verified to ascertain his identity ahead of his next court hearing on Aug 24.

Jeff, who is being remanded in Kajang Prison, is but one of the 2,718 male juveniles aged 14-20 who are at the Kajang, Sungai Buloh and Simpang Renggam jails as of May.  

Many are there for petty crimes, including peddling illegal software, traffic offences and stealing handphones.

Some are also there for serious crimes such as murder, rape, assault and robbery.

James Nayagam, the executive director of Shelter Homes feels that courts need to be informed that youths with petty offences could be detained in Tunas Bakti boarding schools or other boarding schools and not necessarily in prison.

12-year-old and five teens held over abduction and rape

JOHOR BARU: A 12-year-old school dropout has been remanded for the abduction and gang rape of a 30-year-old factory worker.

He and five other teenagers, aged between 16 and 19, were remanded until Aug 10 by magistrate Salawati Djambari at the Johor Baru (South) police district headquarters yesterday.

Acting state CID chief Asst Comm Che Yussof Che Ngah said the victim had been sent for a medical check-up.

On Friday, the victim and her 24 year-old-friend were riding a scooter in Taman Nusa Damai, Pasir Gudang, when a lorry with the six suspects in it overtook them and forced the scooter off the road.  

Both women fell and the suspects bundled the victim into the lorry before driving off, leaving her friend behind.

The victim was taken to a secluded area in Pasir Gudang, where she was gang-raped.  

The victim抯 friend alerted the police, who combed the nearby housing estates and located three of the suspects and the victim in the lorry in Taman Nusa Damai after eight hours.

The suspects fled but were soon arrested along with the others by the police around Kota Masai after a series of raids.

Classes for juvenile prisoners

KAJANG: The Education Ministry will work with the Prisons Department to enable juveniles behind bars to continue with their studies and sit for public examinations.

Education Minister Datuk Seri Hishammuddin Tun Hussein said juvenile prisoners currently had no access to education programmes other than what was carried out by non-governmental organisations.
