tak seronok sangat jd lawyer ni... kene kejar ngan client, kene maki ngan hakim...

lepas tu aku pun tak tahu apa fungsi bar council selain dari tpt lawyer bayar utk membership.

WHAT IS THE FUNCTION OF THE MALAYSIA BAR COUNCIL ?

The Bar Council is the governing body for lawyers practicing in Peninsular Malaysia.
It was established under s. 47 of the Legal Profession Act 1976 (the Act). It's main function is to manage the affairs of the Malaysian Bar and the proper performance of the functions of the Bar. The Malaysian Bar was established with the purposes which include, inter alia, "...uphold[ing] the cause of justice without regard to its own interests or that of its members, uninfluenced by fear or favour".
Standard of professional conduct which lawyers have to follow is also set by the Bar Council.

I WISH TO COMPLAINT ABOUT THE SERVICE PROVIDED BY A LOCAL LAW FIRM. WHO SHOULD I APPROACH TO MAKE THE COMPLAINT ?

If you are not satisfied with the services provided by your lawyer, firstly you should try to sort it out with him. It may be the result of a misunderstanding or a breakdown in communication. If that is not possible you may write to or contact the Bar Council for assistance.

WHAT IS THE STRUCTURE OF THE BAR COUNCIL ?

The Bar Council consists of the President, the Vice-president, the immediate past President, the Chairman of each of the Eleven (11) State Bar Committees, one (1) member elected by each of the eleven (11) State Bars to be its representative to the Bar Council and twelve (12) members elected from throughout peninsular Malaysia by way of postal ballot. In total there are 36 members. These members will manage the affairs and execute the functions of the Malaysian Bar.
Each member of the Bar Council holds office for one year subject to the right of re-election, however the President, Vice-president and Secretary cannot hold office for more than two consecutive years.

WHAT IS THE MALAYSIAN BAR ?

The Malaysian Bar is an independent Bar whose aim is to uphold the cause the cause of justice and oversee the interest of the legal profession. It is established under the Advocates and Solicitors' Ordinance 1947 which ordinance was subsequently repealed by the Legal Profession Act 1976.
To ensure the effective and efficient management of the affairs of the Malaysian Bar, the Bar Council from time to time delegates its power and functions to Committees in the various States throughout Malaysia or to Committees appointed within the Council itself. The State Bar Committees and Committees of the Council are however not independent and have no authority to air any views on behalf of the Bar.

HOW CAN AN ADVOCATE AND SOLICITOR BECOME A MEMBER OF THE MALAYSIAN BAR ?

The legal profession in Malaysian is a fused one with the membership increasing by 10-15% annually. Each advocate and solicitor is automatically a member of the Malaysian bar so long as he or she holds a valid Practicing Certificate.

WHY WAS THE BAR COUNCIL SECRETARIAT BEING ESTABLISHED ?

The Secretariat is established as the administrative center of the Bar Council, a coordinating center for all Bar Council Activities. It ensures that decisions and policies of the Council are enforced.
The Secretariat is headed by an Executive Director and assisted by four (4) legally qualified executive officers and is divided into several departments - Petitions for Admission, Annual Practicing Certificates, Human Rights, Legal Aid, Continuing Legal Education, Accounts, Directory Inquiries, Computerization and General Inquiries relating to the practice of law in Peninsular Malaysia to name a few.
The Secretariat also organizes and coordinates seminars, lectures and talks for members of the Bar and pupils-in-chambers, sports, and social events between members of the Malaysian Bar and neighboring Bars, convening Extraordinary General Meetings or Annual General Meeting of the Bar and fund raising activities.

DOES THE BAR COUNCIL LIBRARY PROVIDES ITS FACILITIES TO THE PUBLIC ?

The Bar Council Library was established in 1979 to provide basic library facilities to members of the Malaysian Bar.
Members of the Bar requiring assistance may contact the librarian or assistant librarian
The Bar Council Library is open from 8.00 am to 5.00 pm (Monday - Friday) and 8.00 am to 12.30 PM (Saturday).
WHAT IS BAR COUNCIL LEGAL AID SCHEME ?

This Bar Council Legal Aid Scheme launched in 1983 is to provide legal aid to poor persons with legal problems by volunteer lawyers who are all members of the Bar. The scheme is currently fully financed by members of the Bar themselves who pay a levy of RM100 each per annum to the centrally operated Bar Council Legal Aid Fund.
Under the Scheme, Bar Council Legal Aid Centres are being set up to enable persons seeking legal aid to meet volunteer lawyers at a central point.
The scope of legal advice and assistance is given only in cases involving

  • Family matters - Custody of children, divorce, maintenance, matrimonial property, rights of inheritance
  • Industrial accidents
  • Employment
  • Housing and Tenancy matters
  • Detention
  • Consumer problems
  • Criminal matters
As the Scheme is meant only for the poor and needy, every person seeking legal aid is required to undergo a mandatory means test. To qualify for the assistance under the Scheme the applicant will be asked their income and their expenditure in order to ascertain their disposable income. Another criteria considered is their assets. Applicants who own assets of above a certain level may not qualify for legal aid. In addition to the mean test, certain applications may also be considered under the Merit Test.

WHAT IS THE DIFFERENCE BETWEEN THE BAR COUNCIL LEGAL AID SCHEME AND THE GOVERNMENT LEGAL AID BUREAU ?

The main difference between Legal Aid provided by the Bar Council and Government Legal Aid Bureau, also known as BBG (Biro Bantuan Guaman) is that BBG is government-funded legal aid and their lawyers consist of salaried government officers and a panel of lawyers who may be assigned cases. These lawyers are paid certain assigned fees when litigants are assigned counsel from the Government panel of lawyers. This is in contrast for lawyers providing Legal Aid services to the clients of the BCLAC - these lawyers provide their services for free.

ha ha too good to be true....

young lawyers especially boleh kira berapa banyak yg dtg meeting bar council.tiap kali meeting selalu tak cukup korum

kenapa lawyer malas pegi meeting? aku pun tak tahu... especially malay lawyer... sbb tu org kat bar ni ramai non malay....

aku personally rasa bar council ni lebih menyusahkan ngan mcm2 rules yg tah hapa2... masa mula2 nak bukak firm aku nak tanya prosedur dan cara pun bar council maleh nak jawab...

young lawyer actually takde tpt nak suarakan "kebanngangan" especially bab2 conveyancing, yg memang totally different dengan apa yg kita belajar kat u.so nak tak nak terpaksa la berharap pada experience clerk @ budak2 despatch kadang@

Dari segi teori itulah dia. kalau takde Malay lawyers dalam Bar Council tuh its their fault laa...sape suh tak nak aktif? Malay attitude dari sekolah sampai masuk bidang professional always malas nak participate dalam benda2 sosial camni.

Kalau korum tak cukup tuh kena salahkan org yg tak nak dtg...nape nak salahkan badan yang dah susah payah nak buat meeting.

Rasenya tanggapan u tuh dah silap.

katekan korg dah bebetul tekad/nekad nk amek law jugak lps spm/stpm or yg sewaktu dgn nya...

so korg pon la pilih ipta/s ( x kurang dr 7,8 ipta/s yg offer law course kat mesia nie)...utk ipta, setau aku ade 4 yg offer law, uitm, uia, ukm dan um....degree 4 taun (kt uitm 6 parts utk degree, 2 parts utk hons.)...so dlm 4 taun tu ade compulsory subject dan ade yg elective...compulsory maknenyer nk x nk sumer student law kt ipta/s kene amek, elective maknenyer korg leh pilih subject yg korg minat/specialize utk subject tu yg korg rase bergune mase korg nk practise karang...

subject2 yg generally compulsory kt sume ipta/s: tort/contract, land, famili, criminal, civil, procedures, constitutional, equity/trust, conveyancing, jurisprudence, company, international...

subject yg elective (maybe compulsory kt certain ipta/s): banking, mooting, professional practice, ADR, consumer, shipping, IP, building contract, commercial, labour etc..

so, dlm 4 taun ni, korg kene expect la quiz, assignment, open book test, presentation etc...sbb law ni bnyk mende perlu dihapal, mcm kes law, rules, principle n proviso etc, maka nnti akan kuar la mcm2 kaedah utk mengingat sume tu, sampai la ke kaedah utk bwk toyol etc... (toyol penting, tu sbahagian drp ciri2 utk menjadi seorang loyer yg keji..)

sbb aku citer ni psl civil (bkn shariah) law, so sbagai intro sblm aku citer psl alam chambering/practising, aku nk citer sket division of law/jurisdiction...

paling atas skali, law nie awal2 lagi die pecah 3, civil, criminal dan shariah...civil ni utk sumer matter civil mcm land, famili (civil) contract/tort etc..in short matters di mana pihak2 yg terlibat adelah individu, syarikat .criminal jurisdiction plak utk matters yg melibatkan offences to the State, cnth mcm kes bunuh, rogol, curik rompak tu....shariah korg tau la kan ape jurisdiction dia, marriage divorce, harta pusaka, hak penjagaan anak sumer yg berkaitan ngan muslim..

tu paling atas, so under civil jurisdiction td, die akan pecah kpd due lagi...litigation dan conveyancing...litigation makne paling senang, loyer yg korg nmpk pegi kort tu...die adelah loyer utk litigate kes, ni utk contested matters la...criminal ke civil matter ke, accident ke etc...ataupon 1 lagi conveyancing...ni loyer utk non contested matters, iaitu loyer ni x pergi kort tp die akan draft Sales & Purchase agreement or prepare loan documntation, g stamping kt stamping office ke, g wat land search kt land office ke, in short, die g opis pakai baju kaler warna warni... ...(ade jugak loyer yg wat litigation dan conveyancing at the same time)

then, under litigation td tu, die akan pecah kpd 2 jugak, same ade loyer tu wat general matter or specific matter...general matter maknenyer loyer tu die wat sumer matter under civil jurisdiction td x kire la land matter ke, famili matter ke etc...or kalu die specialize dlm sesuatu matter tu, maknenyer die akan wat kes2 utk bidang die sahaja...cnth ade loyer yg hanye wat banking work, ade yg wat accident matter sahaja, ade yg wat criminal matter sahaja, ade yg wat IP sahaja..

di post akan dtg, aku akan citer psl alam chambering, the next step before korg jd advocates & solicitors...

nota kaki: post aku adelah secare general utk local law student (bkn utk oversi grad yg perlu amek CLP)

ntah la...kwn2 aku ramai bg law. satu menda yg aku perasaan antara aku ngan diaorg...perbezaan pemikiran yg amat ketara. ketepikan diaorg yg asyik nk menang biler bercakap. tp...biler aku ckp psl satu2 menda, kdg2 diorg bg pendapat yg bukan berkenaan menda tu, tp menda lain yg lain maksudnyer tp dr term yg lebey kurang samey. kadang2 biler aku tanyer satu2 soklan, diaorg akan jawab menda lain...bukan aper yg aku maksudkan. aku malas manyak citer. lantak je la...

aku pernah bincang psl ni dgn kwn yg samer bg ngan aku. die pun raser mender yg samer.

cuba ko masuk bertanding duduk kat comittee tahun depan,, buat la program best2 sikit...lepastu ko suruh bar council protect la interest member lebih sikit jgn tahu mintak duit membership je tapi tak de perkhidmatan sangat especially pada young lawyer...at least benarkanlah young lawyer duduk dalam comittee

budak company secretary takde ke kat sini?
pengalaman aku keje ni letih nak melayan director yang mengada-ngada
director yang tiba2 nak tukar directorship/shareholding pastu kene siap assignment
dalam jangkamasa yang sungguh singkat. mau berapi jugak.
share nak kasi orang tu, officially dia punya tapi presign orang lain punya
politiks beb

ada... dlm bod ni ada a few yg ada license.... hehehe.. tp aku takder license..   ko buat comp secr tu internal ker or ko from external?  if external sure pressure dgn kerenah client kan... kalau internal plak pressure dgn directors, other depts, etc...

aku pun pernah kena buat corporate secr work but dlm sebuah GLC (internal)..  so cover corp sec, buat bits of legal, bits of compliance, corporate exercises.
kalau company tu listed, GLC, ada belas2 director, mmg memeningkan... mcm2 ragam....  paling common yg aku tak tahan bila time nak set meeting date for board committees mtg yg quorum dia cuma 5-6 org... omg.. masing2 vip, busy2... susah giler nak cari common date... bila da dapat common date plak, ada plak yg nak tukar lagi!!!! eeeee :@  n then kena layan director elok2, jaga protocol.. but now i'm in an MNC.. im not doing that much secretarial work anymore, more on legal.. and da no more protocol.. hehehe..

but my knowledge in corporate  rasa mcm makin melingkup sekarang ni.. dah berzaman tak bukak bursa malaysia listing requirements, SC rulings, etc...
