KUALA LUMPUR: Actor and comedian Johan Raja Lawak has won a lawsuit against a drama director and a film production company over the injuries he suffered during a discussion four years ago.
In allowing the suit filed by Johan and his wife, actress Rozlinawaty Ismail, or better known as Ozlynn Wati, Judge Datuk Su Geok Yiam also ordered the defendants, Mohd Javed Mohd Nizar and Juara Filem Sdn Bhd, to pay the damages and costs, which amount would be decided on Jan 23, to the couple.
The court also rejected the RM2 million countersuit filed by Mohd Javed, 37, and the production company.
On July 18, 2010, Johan, 29, and Ozlynn, 32, filed a RM1 million suit against the defendants, claiming that Mohd Javed had assaulted and hurled a drinking glass at Johan, which caused him to suffer an injury on the forehead, when they met for a discussion at a restaurant in Sikamat, Seremban, Negri Sembilan on May 11, 2010.
In the statement of claims, Johan, who is also a radio deejay, claimed that Mohd Javed flipped their table out of anger and that he (Johan) was also punched in the eye by a production crew known only as Halim.
Johan claimed that Mohd Javed and Halim continued to hit and kick him, and when Ozlynn tried to stop them, she also had her share of their brutality.
The comedian also claimed that the director had written and send a defamatory email against them, which was sent to the Malaysian Artiste Association on May 20, 2010.
Johan claimed that the words used by Mohd Javed in the email implied that he was unfit to be hired as actor, always late, uncooperative and a problem maker to the extent of being fired from the drama production.
The actor claimed that the day prior to the incident (May 10), his mother, Salwa Md Dani, died of brain tumour, and that he and his wife had to arrange for the funeral and could only arrive at the filming location at 4 pm the following day.
The two plaintiffs demanded RM1 million in general damages, together with special damages, costs and other relief deemed fit by the court.
They also demanded the two defendant to make a public apology through the local print and electronic media, as well as to withdraw the defamatory email.
The couple was represented by lawyer Suhaimi Saad and Zahrin Ishak, while the defendants were represented by lawyer Baljit Singh. -- BERNAMA
