KADAR SHAH: Believed to be still overseas
IT has been more than a month since Datuk Kadar Shah Sulaiman Ninam Shah's bungalow was broken into and his maid allegedly gang-raped but the Umno strongman has still not returned home from abroad.
Police are puzzled over Kadar Shah's reluctance or urgency to assist with investigations.
Selangor police chief DCP Datuk Khalid Abu Bakar said: "We are still waiting for him to come forward to assist us."
Kadar Shah's lawyer, Steven How, said yesterday he is unaware of his client's whereabouts. His close friends were also in the dark.
The Umno Muar division committee member is being sought by police to assist in investigations into a recent robbery-gang rape at his Shah Alam bungalow on June 21.
Kadar Shah was reportedly in Jakarta when the crime occurred and later went to Los Angeles on business and to attend his children's graduation.
His apparent reluctance to return home to deal with this serious matter has heightened speculation on what actually transpired during the home invasion.
Sources said the maid's statement to the police had discrepancies and that her gang-rape claim was in doubt. Police have not ruled out the possibility that she could have aided the robbers to enter the home.
Police have not ascertained what was taken from Kadar Shah's home in the robbery and the sources said it was strange that Kadar Shah had not returned home immediately to determine loss of valuables.
At least seven parang-wielding men reportedly broke into Kadar Shah's bungalow at Greenville, SAAS Golf Club in Shah Alam, in the early hours of June 21. |

According to police, the woman has been released but the investigation into the case is still ongoing.
Police are tight-lipped when asked further on the status of the case.
On June 21, Kadar Shah's bungalow was robbed. He was in Jakarta when the incident occurred.
The maid claimed she was also raped in the incident when parang-wielding men broke into the bungalow at Greenville, S.A.A.S Golf Club in Shah Alam. Police have not ruled out the possibility the maid could have aided the robbers to enter the home.
Kadar Shah came into the limelight recently when he admitted to helping Manohara Odelia Pinot escape from Kelantan royal Tengku Muhammad Fakhry. |

Kadar Shah loses court battle

Missing’ Umno politician ordered to settle RM1m loan, kadar shah

DATUK Kadar Shah Sulaiman Ninam Shah, the "missing" Umno politician, has ended up the loser in the nine-year court battle with a businessman involving a RM1 million loan.
The Federal Court yesterday dismissed his final legal recourse with costs - which means Kadar Shah has exhausted all avenues for an appeal.
And for the second time in nine years, Kadar Shah may have to contend with a writ of seizure and sale. In October 2000, Kadar Shah paid RM501,753.44, being part of the RM1 million, to the lender Mohammed Norlizam Jailani, 39, after such a writ was executed. Kadar Shah had obtained a holding over order last July 3 pertaining to the writ of seizure and sale filed by Mohammed Norlizam on June 30 for the recovery of the balance of money owed to him.
Kadar Shah has sought a declaration that it was the duty of the respondent to apply for the release of the sum of RM300,000 deposited by him in the Court of Appeal on July 18, 2002.
The Shah Alam High Court will rule on the application on Sept 4. Mohammed Norlizam is now at liberty to take all the relevant steps to file an application for assessment of damages by the Registrar as ordered by the Johor Baru High Court.
The High Court had ordered Kadar Shah in 2002 to pay RM468,000, calculated as of June 30, 2009 to Mohammed Norlizam. Yesterday, the Federal Court dismissed Kadar Shah's notice of motion to seek leave to appeal to the Federal Court against the decision of the Court of Appeal on April 22. He was also ordered to pay RM10,000 in costs.
The Court of Appeal had then unanimously dismissed Kadar Shah's appeal and ordered him to pay the RM300,000.
The matter yesterday was heard before Tan Sri Ariffin Zakaria, Tan Sri Richard Malanjum and Datuk James Foong Cheng Yuen.
The quorum was of the opinion that the question posed by the applicant was more a question of fact rather than a question of law.
Further, the court was also mindful of the fact that the sum of RM500,000 was only paid to the respondent after a summary judgment was obtained against the applicant.
Vadivu Perumal appeared for Mohammed Norlizam while Kadar Shah was represented by Sri Dev Nair.
Kadar Shah, a committee member of the Muar Umno division, was not available for comment. It has been more than a month since his bungalow was broken into and his maid allegedly gang-raped but he has still not returned home from abroad.
He had said he was in the United States to attend his children's graduation and on business.
Police are puzzled over Kadar Shah's reluctance or urgency to assist in investigations.

SELANGOR police have made a breakthrough in their investigations into the robbery-gang rape at the home of Umno politician Datuk Kadar Shah Sulaiman Ninam Shah on June 21 following the arrest of two men soon after four of their accomplices were gunned down in Rawang yesterday.
The pair, believed to be the remaining members of the feared Pak Ee Gang, are expected to shed light into the highly publicised robbery at Kadar Shah's bungalow in Shah Alam due to talk that there were certain "sensitive" items taken from the houses.
Kadar Shah has yet to provide the exact amount of valuables robbed to investigators as he was abroad in Jakarta during the early morning home invasion during which his maid claimed that she was gang-raped. Investigators are hoping Kadar Shah would return immediately to help wrap up their investigations.
Kadar Shah's current whereabouts are unknown but he had earlier told friends that he was in the US on business and to attend his children's graduation.
The two gang members would also be able to help police get a clearer picture of the rape claim by Kadar Shah's maid as her statement to police had inconsistencies. She was held under remand for five days.
The two men were nabbed at a house in Ampang.
Police had been hunting the Pak Ee Gang since the robbery at Kadar Shah's Section 13 home.
In yesterday's dramatic shooting that took place about 6.15am opposite a cement factory on Jalan Bristol, Rawang, the four Pak Ee Gang members, aged between 22 and 39, were shot dead when they attacked a police team trailing them.
At the scene, Selangor police chief DCP Datuk Khalid Abu Bakar said police received information that the suspects had failed to break into a houses in Jinjang, Kepong.
"We traced the gang, driving a gold coloured Proton Waja, to the Selayang wet market and followed them all the way to Rawang," said Khalid.
Near Jalan Bristol, the gang members realised they were being followed. The four attempted to hide from police team by stopping the car and switching off the lights.
However, when the police team moved in, the driver panicked and lost control of the vehicle. It plunged into a drain near the cement factory.
"When they found themselves surrounded, the robbers, who were armed with parang and sickles, dashed out of their car and tried to attack the policemen."
It was learnt that one of the robbers tried to throw a parang at the cops.
"Policemen fired several shots, killing the four men on the spot," Khalid said.
Police found three machetes, a sickle, two screwdrivers and a metal cutter which were believed to have been used in their crime spree.
The bodies of the robbers, three of whom were identified as Iskandar Hassan, 37, Rifai'i, 39, and Lutfi, were sent to the Sungai Buloh Hospital for post-mortem. |

Kadar Shah’s ex-wife seeks millions in damages in Syariah Court
Pearl Lee
Friday, August 21st, 2009 07:21:00
This time around, it involves a multi-million ringgit claim by his former wife Datin Fauziah Haron who has filed a claim for her rights under Syariah Law for alimony, maintenance, return of debts as well as compensation.
In her application that was made in July last year at the Kuala Lumpur Syariah Court, Fauziah is seeking:
1. Compensation for three months waiting period after divorce at RM20,000 a month for three months totalling RM60,000;
2. For maintenance arrears at RM10,000 a month totalling RM600,000;
3. A return of her money for the payment for her Mercedes Benz SLK that Kadar had stopped paying for costing RM250,000;
4. A return of money made in 2003 under a loan agreement totalling RM1.8 million;
5. A lump sum Mutaah (alimony) of RM5 million;
6. Shares at Bredeno Shaw Sdn Bhd held by Kadar Shah that Fauziah seeks to be declared as matrimonial property worth RM1.5 million;
7. A condominium unit in Genting Highlands;
8. A house in Shah Alam;
9. An apartment in Hawaii;
10. An apartment in California; and
11. Four cars - a Mercedes-Benz, a Porsche, a Ferrari and a Range Rover
Kadar Shah, who was not persent at the hearing at the Kuala Lumpur Syariah Court yesterday had, through his lawyer Sulaiman Abdullah, filed a preliminary objection against Fauziah's claims on the basis that she had no legal standing to claim any of the rights under Islamic law as the marriage was irregular.
Further applications were made by Kadar Shah to the court saying that the court had no jurisdiction to hear the case as there was no valid marriage to begin with.
Syariah judge Mohd Shukor Sabuddin, however, rejected Kadar Shah's preliminary objection and instead ruled that it had the jurisdiction to hear the case as the subject matter involves Muslim marriages and the wife, who is the plaintiff in the case, had the legal standing in her application.
The court also rejected an application of a stay of proceeding over the claims.
The court later set Nov 5 as the trial date for the case.
Kadar Shah and Fauziah were married in Jakarta in 1980 but their marriage was never registered here.
In 2002, problems surfaced and Fauziah initiated divorce proceeding at the Shah Alam Syariah (Lower) Court in 2003.
Problems occurred as the courts had to first decide on the validity of their marriage.
In November 2007, the Shah Alam court declared that their marriage was irregular as the parties were not able to produce a marriage document and they were also unable to produce witnesses to prove their marriage.
As the marriage was not a valid one, the court said there was no room for a divorce.
However, Fauziah pursued the matter and filed a case at the KL Syariah Court in July last year.
Fauziah's lawyer Kamar Ainiah Kamaruzaman said Fauziah had a right to her claims as both parties entered the marriage in good faith.
The couple have three children-two boys aged 28 and 25 and a 23-year-old daughter.
The marriage with Fauziah was said to be Kadar Shah's second marriage.
He had earlier been married to an Australian woman.
EX-WIFE Fauziah lists out allegations against Kadar Shah
DATIN Fauziah Haron, the ex-wife of Datuk Kadar Shah Sulaiman Nimam Shah, has made several allegations against her ex-husband.
Among the allegations in her statement of claim for alimony payment in 2008 were Kadar Shah’s robust character, the threats as well as the vulgarity that was hurled to her after she found out that he had lied about his first wife in 2002.
His abuse reached a limit where she could no longer take it and had to flee to her sister’s home for refuge.
However, Kadar Shah did not stop and he continued with his threats.
To avoid Kadar Shah’s disturbances, Fauziah agreed to enter into an agreement with him on Aug 6, 2002 where both parties agreed that they would live separately until they found an amicable solution to their marital problems.
Among the terms of the agreement was that both parties be allowed to meet their children without any resistance from either party and Kadar Shah had also agreed to continue to pay for her personal expenses.
Both parties agreed that their present lifestyle would not be affected.
However, after the agreement was entered into, Fauziah was not allowed to meet her children.
It was also alleged that Kadar Shah had threatened his children that if they met their mother, he would stop paying for their school and other expenses.
Fauziah commenced divorce proceeding in 2003.
As their marriage was never registered in Malaysia, Fauziah was forced to make an application to the Shah Alam Syariah Court to decide the legality of their marriage to enable the marriage to be registered here.
However, Kadar Shah had said Fauziah had no jurisdiction in the case and even after his grounds were rejected, did not cooperate to verify their marriage.
It was also alleged that he had not produced any evidence and had also refused to testify about the marriage, that was allegedly fully arranged by him.
Throughout their marriage, Fauziah said she had made many sacrifices as a wife and had even taken care of him when he underwent two angio-plasty surgeries in the United States in 1997. She also claimed to have taken care of him throughout the six months rehabilitation at the Los Angeles and Hawaii hospitals.
She claimed that she had always supported and assisted Kadar Shah in his business. She had also often arranged important business meetings and cooked special dishes for his business associates.
Apart from that, she had sacrificed to move and live overseas with him for about four years when he was facing taxation problems.
She stood by him throughout his political career and even when he faced business problems. Fauziah claims to have taken care of his parents when they were ill in hospital.
With regards to their children, she had taken care of them overseas when they went to further their education.
She claimed that throughout their 27 years of marriage, she had gone through the ups-and-downs without failing to fulfill her part in their marriage.
