Tenant rights and lease agreements

Ada orang nak beli bangunan kami (bangunan ini under rent control sebab was build sebelum tahun 1970). Masalahnya sekarang bangunan tsbt dihuni oleh sebuah sykt. Their current lease agreement ends in October of 2008. Kami minta sykt ini break the lease. Mula mula mereka setuju tetapi sekarang mereka tidak setuju sbb it's short notice lagipun tempat tersebut sudah mendatangkan banyak pelangan kpd mereka.
So, I need information regarding our rights in this situation. Can the we break the lease and ask them to leave within a certain amount of time? Boleh tak new owner ''halau'' mereka keluar?

Heheh sori la sebab tanye..lokasi di mana kes berlaku agak penting sebab land law agak berbeza even sesame Commonwealth countries...
Tentang isu awak nie saya kena baca balik la nota2 land law dulu....bole kan? |

kalau lease agreement tu tak provide any escape clause (option to terminate prior to expiry) susah nak terminate the agreement before the expiry of the lease kak dar.. unless both parties agree.. the other option is to offer compensation to them with the hope that they will accept. Otherwise, there is not other way, kena tunggu lease agreement expired jugak. |

Oh saya ingatkan spt di US - beside rent control landlord tak boleh suruh tenant keluar sesuka hati terutamanya for cormecial building.
Masalah betul lah bila bangunan ni under rent control - penyewa tak nak keluar sebab sewa murah dan kita as landlord tak boleh increase sewa setiap tahun. Kalau nak naikkan (ikut harga semasa) kena tunggu penyewa tu keluar dulu. If not stuck situ lah sampai bila bila.

kak dar, talking about compensation, in some of the lease agreement it would provide that a party asking for early termination would have to pay rental for the unexpiired term of the lease (as damages). Since this is rent controlled building, maybe it is not that high to offer compensation as such, or u can suggest to offer half of that amount.
The other option is when u want to sell that building, get the new owner to agree to continue leasing the building to the existing tenant, then terminate the lease agreement u have with that tenant.
Just my suggestion. |

Rasenya saya setuju dgn Airis, lease agreement nie kalau kita nak sewakan lebih 3 tahun dan agreement tu renewed yearly, kalau takde escape clause rasenya kak dar kena tunggu sampai bulan 8 nie lah.. |

Lease memang buat every year. Mula mula dia orang setuju keluar dgn pampasan yang kami nak beri pada mereka memandangkan sykt dia orang tu dah ada nama dan tak ada prob kalau pindah ke tempat lain ... tapi entahlah apa yang buat sykt tu tukar fikiran.
Anyway kena tunggu sampai bulan 8 tahun dpn lah jugak. Jimat duit tak payah bayar apa apa dkt mereka

Rasenya tuh yang elok dan rasenya bertimbangrasa pada tenant sebab walaupun diorang sykt ternama, tapi perlukan masa jugak untuk relocation kedai mereka dan semua tuh rasenya takleh selesai dalam sebulan dua...mungkin perlukan masa nak observe tempat, tgk trafik pelanggan kat kawasan baru tuh dan kemudahan yang ada kat kawasan baru...semua tuh perlukan masa. |

junior or senior makes no difference maaa....u sendiri tau kan who normally we refer to paralegal...
I juz nak perbetulkan..takut ada terconfuse...mcm kat bod mana entah...ada yg refer legal assistant as not a lawyer...

Buat sendiri pun bole..atau senang u translate dan taip balik ajer agreement in English tuh pada BM...abis citer... |

That's what I did for my boss's tenancy agreement dulu.. pening ahh dah lama tak buat keja2 translation nih... dulu masa kat law firm selalu kena buat, pasal ex-boss punya malay hancur giler.. practically every letter I have to translate in order for him to understand and reply.. masa tu kamus English-BM is my bestfren |

Hohoho..arituh pun saya kena translate Afidavit datang dari Ireland...tapi alhamdullilah dapat jugak siapkan...tebal jugak afidavit tuh! |
