nuisance neighbours - JIRAN PROBLEM (ADA TAK TINDAKAN UNDANG2 BOLEH DIAMBIL)

SAYA ADA BELI APARTMENT DI CHERAS CORNER LOT. TIGA PINTU SEBELAH RUMAH  SAYA PEMILIK SEBUAH KILANG BESI. BETUL-BETUL SEBELAH RUMAH SAYA DI LETAKKAN NYA PEKERJA MYAMAR. LAGI DUA PINTU DI LETAKKAN NYA PEKERJA CINA KIRA ADA PANGKAT LA SIKIT. MASALAH YANG SAYA HADAPI IALAH DENGAN PEKERJA MYAMAR. RUMAH MEREKA TERLAMPAU BUSUK MACAM DUDUK DI TEMPAT PEMBUANGAN SAMPAH. LIPAS BERIBU DALAM RUMAH MEREKA. SAYA ADA BUAT ADUAN PADA DBKL. MEREKA CAKAP OK APA BAU MACAM TU, SAYA INGAT MEREKA DAH EJAST DENGAN TOKEY KILANG.

SAYA NAK TANYA DI SINI ADA TAK UNDANG-UNDANG DI MALAYSIA BOLEH SAMAN JIRAN RUMAH YANG MENGGANGU KENTETERAMAN HIDUP. KALAU ADA APA YANG HARUS DILAKUKAN.

PERLU BANTUAN...SEKIAN TERIMA KASIH

kawasan apartment tu kawasan baru, mana nak tahu boleh jadi macam tu. kalau tahu memang tak beli. ada tak siapa siapa kat sini peguam peguam yang handal, minta tolong beri pandangan. terima kasih.

aku bukan le nak ngata kan..
tapi kat rumah aku ni... mmg berdekatan ngan projek SMART banjir2 ni... (kat Cheras gak)
ada le ofis SMART ni sewakan rumah..utk pekerja2 kontrak dia antaranya warga myanmar ni lah..
mmg tak jaga kebersihan..!! pengotor..!! busuk segala..!!
sib baik diorang tak selevel ngan aku.. tapi duk kat level atas rumah aku ngan kat level bawah sebelah rumah kawan hubby aku.. kawan hubby aku tu siap gaduh2 lagi ngan depa pasal suka buang sampah merata-rata... kasut bersepah2.. ada je lah masaalahnya...

kalau ternaik lif ngan diorang..mmg sesak napas dibuatnya..!!

sebenarnya mmg ada peruntukan undang2 utk deal ngan mende2 camni
dlm statut kita mmg xda so as a lacunae <--nih jargon latin maksudnya lompang kosong lebih kurang... kita akan folo common law kat uk.. dlm kes nih kira Law of Tort.. nilah
undang2 yg diguna dlm kes marshita vs noraini <--x igt sapa plaintif pasal kes gantirugi rumput yg glamer dulu2
ko buleh file tort kat civil court mintak injuction/specific order from court...

ada lagi tak info kawan kawan lain...

untuk pengetahuan, saya dah ada tangkap gambar curi-curi dari tingkap dapur. gambar lipas beratus ratus kat dinding, gambar dapur kotor tak ingat, lantai dapor penuh air bertakung. gambar bau saja tak boleh nak tangkap.

ko amik gambar curi2 tu dari mana? masuk umah ke x masuk umah?
kekadang bukti camni inadmissible to the court sbb dia maybe illegally taken.
but at least u can explain better to the court... and ur loyer...
ko xda kengkawan yg loyer ke?? kalo ade ko ajak aaa diorang pegi lunch ker pasti citer aaa...misti lagi detail explanation derang

my suggestions
1. sue the owner as first defendant
2. tenants as second defendant
3. dbkl as third defendant
4. apply for injuction to refrain them from messing up the compound
5. order the dbkl to clear the house as alternative

ni under tort law. private nuisance. boleh minta injunction kat civil court - perintah mahkamah agar nuisance tu dihentikan. kalau boleh prove that u suffer, can claim damages.

yup... mmg ada pun cases kat malaysia (altho tak byk) untuk kes2 nuisance by smell (bau... yucks).
btw just to highlight that dlm law, maksud nuisance dlm bhsa layman  bolehla dikatakan sebagai gangguan kpd hak2 dan keselesaan yg patutnya dinikmati oleh org yg berhak tu. (org berhak dlm hal ni.. pembuka thread la..)

tp  kena cukup syarat2 dia.. benda ni kena la something yg serious.. yg selalu terjadi.. bukan sekali-sekala tercium bau busuk or nampak lipas, bole saman. kena kerap mengalaminya. ada lagila syarat2 lain..

pade pendapat aku... g court nie as a last resort...sbb per?

1. buang duit, buang masa buang tenage..
2. kes nk di dengar tetambah High Court xkn setel dlm setaun..injunction leh dpt early date sbb urgency, tp once opponent engage loyer...mcm2 application dier akan wat...counter injunction, defamation etc..
3. dpt injunction pon, maybe die akan appeal..sblm appeal denga die akan apply stay of execution...mau mkn 18 taun nk settle tuh...

so, per kate settle care baek...bwk bebincang ngan developer, ngan org myanmar tuh....x jln?...komplaint kat pihak2 berwajib...MPAJ ke etc...x jln?..karam singh walia ade...dah kuar tv/paper x jln gak?!

maka, ko carik lagu papa roach-last resort -> engage lawyer!

heheh...lawyers are answerable to their client...so ape pon yg diorg wat, msti 1st skali utk protect client's interest...kalu wat interlocutory application utk delay action tu mmg instruction client, court x leh wat paper, ape tah opponent...:nerd:

sbb tu ade lawyer yg dah di designed khas utk delay matter, dpt je summon dr client straight file application to struck off...x pon dier wat application for further & better particular...dah nk hearing/full trial, file application to amend defence etc..

kes injunction mmg penink kpale...1st, bnyk interlocutory application...2nd, court problem...judge tuka la, judge sakit la, court free date utk sivil high court skangni 2008 and above...pastu mcm aku ckp td, dpt order injunction pon x  gune...salu ade appeal...pastu diorg file stay application...

advice aku mcm td...jgn buang mase g court...unless...hehhee...korg nk mengkayekan loyer...injunction case, legal fees lawyer mmg mahal...

aku pun ade prob dgn jiran
citer aku gini: aku beli rumah subsale...masa beli tu rmh tu mmg basic je la takde apa renovation yg owner lama buat...so aku pun buat la sket2, repair2 mana yg patut...peh tu aku tambah 5 kaki kt belakang dapur and buat dinding 5 kaki, yg atas tu grill and ada bumbung...
lepas dh siap semua aku pun pindah masuk, bila hujan je air hujan dari awning  rumah jiran belakang mencurah2 masuk ke bhgn yg aku tambah tu sbb jiran2 belakang rumah aku tu mostly buat illegal extension(diorg extend dapur sampai makan jalan belakang)
rumah tu pulak bebudak bujang yg duduk, aku pun tak tau nk buat mcm mana...sedih jugak la sbb habis brg2 yg aku letak ktsitu basah...
aku hairan la pihak berwajib tak buat kije ke sbb diorg ni senag2 je buat extension sampai makan jalan....tensen aku

sebelum report-mereport kat majlis perbandaran, apakata ko tanya dulu tuan rumah tu... if dia bole alihkan salur paip tu or repair apa2 yg patut kat rumah dia supaya air tak masuk ur compound.... ko ckp la air byk masuk.. rosak brg2, tempias n actually air mencurah bole lekukkan permukaan...  neighbour aku dulu renovate rumah mcm tu gak.. air mencurah2 masuk kat compound rumah aku.. kitorang bgtau dia.. n tunggu masa hujan lebat to prove it.. so dia repair saluran paip dia.. buat minor renovation kat awning tu.. so problem pun settle..

tul tuh..diskas elok2...gado2 hanye di akhir cerite...:nerd:

tp kalu budak bujang tu mmg wat bodoh je sbb mmg diorg bodoh, ngan slambe ko g ripot kat majlis perbandaran area ko tuh...ko ckp die wat illegal extension, lagi sronok MB/P area ko tuh datang meranapkan extension tuh...

ingat! ape2 extension/renovation yg mengubah rupabentuk bangunan or fungsi bangunan, perlu dpt consent dr majlis bandaraya berkaitan...kalu x jd illegal...cnth cam opis aku, dabel stori house, so nk renovate jd opis kitorg apply kat dbkl...dpt kebenaran, kang dbkl kuar la certificate dier...
