Mayday! Mayday! Urgent nie... pls advised!

Salam forumers,
I skrg ader masalah besarrrrr punyer neh.... berkenaan beli rumah subsale dr owner...
I dh diskas at first dgn owner psl deposit+lawyer sumer2 tu...so owner agreed i byr deposit after withdraw EPF.
BUT, nie base on trust jer...verbally...xde signed ape2 eg letter of intent ker hape... <--stupid me!
So, nie summary kes i nie... please advised what shud I do now...

Situasi 1:

Loan I dah approved. Dah signed LO and dah returned LO kt bank. So, bank skrg tgh tggu salinan SnP jer utk prepare Loan Agreement plak.

Situasi 2:

Dh engaged lawyer tp depa wat keja mcm siput sedut satu hal. Lame giler nk prepare SnP. So skrg katenyer dh siap and dah boleh sign hari Khamis or Jumaat nie.

Masalah skrg nie.... TIBER2 owner bgtau nk cancel sale tu...
sbb katenyer dia dh rasa xmo jual plak rumah tu...which is I doubt dia nk up harga rumah...
Yang I nk tau skrg nie, mohon para forumer yg arif bab rumah nie kan, WHAT SHUD I DO???

1) Kalo I nk fight blk boleh ker? sbb everything dh siap, tggu sign jer... BUT, I mmg xde byr deposit ker hapa kt owner bcoz as agreed, kalo loan I approved, kira jadi laa beli rumah tu....

2) Kalo I cancel loan dgn bank & cancel SnP singing, I kene penalty tak? If yes, like how much I kene byr kt bank/lawyer?

3) If owner berkeras xmo sign jgk SnP tu, boleh tak i saman dia or I mintak gantirugi (which is cover ALL cost incurred from the cancellation of loan + lawyer?)

Thanks forumers! I dh buntu tak tau nk buat apa lg dh nie....rase nk nangesssss jerrr!!!!

atleast you bagilah deposit untuk booking dulu
kalo melalui ejen selalunya 3%, 7% balance after withdraw epf
so you boleh jer bagi dalam 1k dulu sebab owner jenis boleh dibawa berbincang rasanya

dah jadi macam ni, owner boleh lepas tangan sebab xde resit
pasal cancel loan, kena bayar penalty juga tu tapi tak confirm bape % dari loan

gulp...pity you TT.

BUt for me, tuan rumah berhak buat macam tu sebab dia boleh beranggapan yang TT tidak berminat/serious untuk beli rumah dia. Tapi ini untuk tuan rumah yang kurang berperikemanusian lah..hehe...

tapi TT perlu ingat, zaman sekarang adalah zaman duit dan zaman segalanya perlu perjanjian hitam putih hatta pinjaman hanya lima puluh ringgit sebab hati manusia ini susah nak diramalkan. Sedangkan ada perjanjian pun, orang biasa ingkar, inikan pula yang  tiada perjanjian.

u have no SNP signed yet. and no deposit.----- legally the seller is at no fault
unfortunately u have to pay for the penalty and legal processing cost. the legal processing cost depends on what stage of your case right now. call up ur banker and see how much is the cancellation penalty is

cikanggun, bila s&p cancelled, memang u kena bayar lawyer's fee & disbursement tapi x la full fee. mungkin 20% ke daripada full fee, depends on stage of works & legal firm tu jugak sebab s&p semua dah draft, lain2 docs dah prepare, etc...
macam loan pulak mungkin u kena bayar mungkin jugak x, depends on bank..lagipun u cuma signed letter of offer je kan? kalau kena bayar pun, mungkin diorang akan charge admin fee je..
macam kes u ni, u discuss la with the seller, bagitau dia s&p, loan semua dah ok, tunggu sign je. bila dia nak cancel, u kena bayar all the costs. Kalau dia nak cancel jugak, cuba tanya dia samada dia boleh bayar separuh atau x..

tp aritu ader tanye psl lawyer fees jgk...
dunno yet..dia ckp nnt dia diskas dgn bos dia dulu....

psl seller tu, mmg rase dh mls nk contact...
biar opis lawyer jer laaa handle...byr fees diorg nnt, suh si seller tu tanggung...
psl dia yg suddenly nk cancel...bleh gitu?

kalau S & P lom sign susahlah nak fight sbb xde hitam putih
klu dah bayar booking fee  lain sikit

pasal lawyer's fee klu ikut norma biasa selalunya yg kena bayar adalah sapa yg enggage loyer SPA tue dan pasal bank pulak cuba nego dgn diaorg mana tahu x banyak sgt kena bayar
