nak tanya pendapat pasal termination notice

salam,
ako nak tanya pendapat pd orang yang arif issue2 hr nih..

dalam Terms and Condition offer letter ako (2 thn lepas) tpt keje ako sekarang kata termination notice 1 bulan. nih ako sign and agreed.

dlm offer ako, ader clause :
"In the even of a conflict betweenthe Terms and Conditions and the employment Handbook, The provisions ofthe Terms and Conditions shall prevail"


pastu thn lepas kuar employee handbook (status handbook tuh masih lagi "draft" sampai la nih), tulis termination notice dah jd 2 bln lak... dia takde mintak sign ker apaper utk mende nih...



katakan ako nak resign, ako kena follow handbook ker offer letter? Dr pemahaman ako Terms & condition tuh lagi powerfull dr employment handbook kan?

dulu, ako sajer borak ngan hr ako pasal termination notice, dia kata 2 bln.. ako senyap jek la takde argue2 pon.sbb ako belom nak resign lagi.. just tanya2 jek..

setahu aku nak berenti kalau tak nak kena bayar ikut jer la apa hr tu kate, tp kalau tak kesah ko kena ganti rugi ker blah jer la

dah sah sah la hr tuh kata 2 bln... tp dr segi legal nih ako nak ikut 1 ker 2 bln..

ala, pas dpt gaji tak yah dtg terus........ dlm t&c kan mesti ada tulis kalau employee tak dtg keje tanp[a sebab dlm certain period, co boleh terminate....... so senang citer takyah dtg keje, tak yah hantar surat........

tuh solution yang paling senang.. tp personal feeling ako kata unethical..

sebolehnyer ako tanak buat cam tuh sbb boss jepon ako baik.. so sebolehnyer ako nak kuar cara baik.. lain la company tuh 100% treat ako cam taik, harus ako ikut pendapat ko..

ako cuma nak tau legally ako kena 1 month or 2 months... so sesapa yg arif bab contract nih tolong la advise..

referring pada contract tuh pun dia dah kata kan...kalau ada conflict antara contract n handbook, ambik yg contract jugak..

so as long as takda contract lain yg hang dah sign, by right notice u still 1 month as per what it says in the contract.

tu da ada stated kat offer letter tu, so maknanya akan ikut T&C kat letter tu, tak kisahlah apa employee's handbook ckp. kalau HR ko bising2, ko tunjuk je surat tu, highlight siap2 kat clause tu.

Kalau dia dah keluarkan satu memo kepada semua staf lepas dia tukar notice period kat handbook tu, bgtau yg skang company akan guna notice 2 bulan, jadi yg handbook tu akan digunapakai. kalau takde memo or pekeliling apa-apa, T&C asal kat offer letter ko la yg sah.

Baik ko periksa siap2, ada x company issue apa2 memo regarding notice period lepas dia kuarkan handbook tu. kang kalau ko argue, pastu ada memo, wat malu je.

setau ako takde black and white memo.. dia just ckp mulut jek pasal handbook..

anyway all tq for the advise... ako lom nak resign lagi.. cuma nak tanya hak ako incase ako nak resign..

wow...senangnya solution...tp jgn lupa ek...majikan pun boleh tuntut balik gaji ganti notis kat pjbt tenaga kerja wpun pekerja tu hilang mcm tu jer.

btw, tuminah, ikut jer offer lttr yg awak sign dulu. lgpun employee handbook tu dlm peringkat draf. dulik apa. tp, utk mengelakkan isu2 yg akan timbul di kemudian hari, bole gak bg notis berenti berdasarkan akta kerja 1955. (aku xingat seksyen berapa sbb malas nak amik buku akta skrg)

Kerja kurang 2 thn - notis berenti 4 minggu
Kerja lbh 2 thn, kurang 5 thn - notis berenti 6 minggu
Kerja lbh 5 thn - notis berenti 8 minggu
