resigned short notice

Sapa pernah ada experience resigned with short notice? company boleh ambik action x?

aku dah resigned with 1 week notice. Padahal dalam contract kena notice 3 bulan. HR dah bagi surat jumlah amount yang kena bayar.. skg salary still under hold sebab dia tunggu pampasan kerugian dulu. Kl aku x bayar, company boleh ambik action x?

Note : Reason aku resigned sebab kena buat kerja 2 3 4 orang.. staff lain resigned, company tak hire orang baru (alasan, hire freeze)  tapi orang lama kena take over kerja dia. So, aku terpaksa bekerja sehingga jam 2 3 pagi, free of charges.

please advice!!!!!

ikut undang undang di EU, tribunal akan dapati company bersalah dan akan terpaksa bayar YOU pampasan; juga company akan didenda kerana paksa orang buat kerja diluar JD; di Mesia, wallahualam; labour law sgt lemah dimesia. Sepatutnya you buat bising dgn hantar surat surat (bukan email kerana ianya digital evidence je) sebelum you ambil tindakan resign at short notice.

kan kan? lebih lebih lagi yang keje swasta... sampai kol 10-12mlm stil kat jabat. padahal yang utama adalah productivity, ie outcome.. bukan how much time put in. Walaubagaimanapun, if mmg kene keje samapi kol 10mlm, maka company kena la bayar.. ni kita kat mesia takut pon nak claim..

kena bayar..kalau dlm offer letter dah terang2 kata notice period is 3 bulan..
any termination from any side..kena bg notis 3 bulan atau salary in lieu..

kalo nak buat claim pasal brenti sbb teda tahan kerja..etc etc..
bleh jer pergi mereport ke labour office, kalo ada bukti2 kukuh..

tapi benda tu separately lah dgn permasalahan ko nih..
notice period still kena follow regardless of kenapa ko nak brenti or diberhentikan..

first of all,

before u resigned, ada tak u failkan report pasal ur dissatisfaction with ur boss? or HR?
company u ada tak grievance process?

boleh... kena kemukakan sekali dgn bukti... unch card ke.. slip keje ke...
tapi kampeni tetap berhak utk buat tuntutan sbb resign tak ikut masa yg ditetapkan...

mmg company boleh ambil tindakan.. tp kalau ocmpany kecik selalunye kasi Notice of Demand pastu senyap je. sanggup ke depa nak gi jauh masuk court bagai. silap2 backfired company tu balik.

if i were u, halalkan ajer gaji yg freeze tu dan buat taktau. depends kat company tu nak ambik further action apa. kalau nk further action pun main kos jgk ie. legal bills lawyer, time etc.. berbaloi ke..  @nor5480
