S.M Faisal Dan Emilia Bincang Selesai Kes Pukul Cara Baik

KUALA LUMPUR – Perbicaraan kes ahli perniagaan Datuk S.M Faisal S.M Nasimuddin yang didakwa mencederakan bekas isterinya Emilia Hanafi memasuki episod baharu apabila kes itu akan diselesaikan di Mahkamah Majistret di sini.
Dalam prosiding hari ini, peguam pemerhati Nazri Yahya yang mewakili pihak pengadu iaitu Emilia memaklumkan, ini kerana pihak-pihak berhasrat secara serius untuk menyelesaikan kes.
“Sepatutnya Emilia memberi keterangannya hari ini. Namun, saya ingin memaklumkan pihak-pihak (Emilia dan S.M Faisal) berhasrat untuk berunding secara serius untuk menyelesaikan kes.
“Perkara itu sudah dimaklumkan kepada peguam S.M Faisal, oleh demikian kami mohon supaya dapat diizinkan bahawa mahkamah boleh melapangkan kes hari ini. Kami ada tarikh untuk memberi makluman mengenai status rundingan iaitu sebelum atau pada 30 Mac,” katanya.

Mendengar perkara itu, peguam bela S.M Faisal, Datuk Akberdin Abdul Kader, kemudian mengesahkan perkara yang dimaklumkan peguam pemerhati itu bahawa terdapat inisiatif kedua-dua pihak untuk menyelesaikan kes.
”Pagi ini Nazri (peguam pemerhati) memberitahu perkara sama. Saya sudah beritahu peguam itu kita akan lakukan yang terbaik untuk selesaikan (kes) mengikut cadangan tertakluk terma anak guam.
“Saya mohon mahkamah rekodkan jika tiada penyelesaian dan tidak mahu membuang masa kita teruskan bicara pada 30 Mac. Saya tiada bantahan terhadap permohonan untuk melapangkan kes hari ini,” katanya.

Selepas mendengar makluman kedua-dua belah pihak, Majistret Nadia Othman kemudian menetapkan 30 Mac ini bagi pihak-pihak memaklumkan status rundingan penyelesaian kes berkenaan.
Sementara itu, Akberdin ketika ditemui selepas prosiding kes berkata, rundingan penyelesaian kes itu termasuk tuntutan harta sepencarian dan mutaah pasangan itu di Mahkamah Syariah.

“Kalau ada penyelesaian, kita selesai semua kes termasuk di Mahkamah Syariah. Ia bergantung kepada terma dan persetujuan kedua-dua pihak. Kita sentiasa terbuka untuk berbincang kerana kes ini sudah berjalan terlalu lama, kita mahu tamatkannya,” kata peguam itu.
Pada Februari lalu, Emilia dalam keterangannya memberitahu sejak menjadi ibu tunggal, dia terpaksa banyak membuat kerja-kerja sambilan antaranya menjual makanan bagi menampung kehidupan.
Antara makanan yang dijual dari rumah ialah roti jala kuah kari, pulut kuning, rendang daging dan kerepek bayam.
Mengikut pertuduhan, S.M Faisal, 43, didakwa dengan sengaja menyebabkan kecederaan ke atas Emilia, 43, di sebuah rumah di Desa Sri Hartamas, Brickfields, antara pukul 12.30 tengah hari hingga 4.30 petang, pada 22 November 2015.
Pertuduhan didakwa mengikut Seksyen 323 Kanun Keseksaan dan boleh dihukum di bawah Seksyen 326A kanun sama, yang membawa hukuman penjara maksimum dua tahun atau denda sehingga RM2,000 atau kedua-duanya, jika sabit kesalahan. – CARI
