Loh gets High Court’s nod over custody of children

Loh Siew Hong was in tears after hearing that she has custody of her twin daughters, aged 14, and 10-year-old son.

KUALA LUMPUR: The High Court today granted single mother Loh Siew Hong’s habeas corpus application to recover the custody of her three children.

Judge Collin Lawrence Sequerah allowed her application after hearing submissions from her lawyers and counsel appearing for preacher Nazirah Nanthakumari Abdullah.

“It (court order) should not be treated punitively,” he said.

Loh broke down in tears after hearing the decision.

She had filed the habeas corpus application seeking the freedom of her 14-year-old twin daughters and 10-year-old son from their alleged detention after being separated from them for three years.

She contended that she had obtained a civil court order giving her custody, care and control of her three children.

Loh claimed she came to know that her children were placed under Nazirah’s care, and alleged that Nazirah refused to let her meet them.

Earlier, her lawyer, A Srimurugan, told the court her case was a “sad” one as she had been separated from her children.

“This is a mother in distress. At this moment, she cannot go one centimetre near her children. It is pure inhuman treatment,” he said, pointing to the children, who were present in the witnesses’ room in the court.

Srimurugan affirmed that Loh’s case “has nothing to do with religion”.

“We don’t know what was the motive (of individuals allegedly holding the children illegally),” he said.

Lawyer Aidil Khalid, appearing for Nazirah, argued that Loh’s habeas corpus application – naming the preacher as the co-respondent – was academic as the children were no longer with her.

He said the children were now under the care of the social welfare department (JKM), to which Loh had consented.

“In her affidavit, she stated how she came to know the (whereabouts of the) children. She does not have custody and control of them as she only met the children during school holidays.

“When the father went missing, she (Nazirah) took the responsibility of taking care of them. They can’t say she held the children illegally,” Aidil said.

He concurred that this was not a case linked to religion.

“However, I want to set the record straight for Nazirah. The applicant claimed there were attempts to change the religion of her children.

“They were said to have converted some time in July 2020 but she (Loh) obtained full custody in 2021, which Nazirah did not know about,” he said.

To be honest, anak mana tak nak ikut either parents dari duduk dgn strangers, unless derang kena abuse teruk punya.

Loh’s children were taken away from her in 2019 while she was hospitalised with injuries she claimed were inflicted by her former husband.

She obtained interim custody of her children in July 2019 pending her divorce, but her court case was delayed when the country went into Covid-19 lockdown in March 2020.

Loh finally obtained full custody of her children in March 2021. She continued searching for them so she could finally take them home.

It was a long search, she told the news portal. On January 10 this year, Loh said she received information that her daughters were at a shelter in Penang while her son contacted her through a friend on Facebook, saying he was attending a tahfiz school in the same state and asking when she could visit.

“By then, I have lodged nine police reports to locate my children, but I am still unable to take my children with me,” she was quoted saying.

I nak tanya you.  Kalaulah it is the other way round, si loh ni islam kawin dgn non muslim convert.  Bila tak de sefahaman gaduh2 cerai hak penjagaan diberi ke emak.  Tak tau apa cerita si bapa bawa anak2 baaah umur ni balik ke ugama asal katalah kristian tak pun hinduism.  Anak2 suka katanya tak de paksaan.  si emak pun viralkan sebijik cerita macam ni. So you akan argue juga ke bapa kandung dia yg bawa jgn dengar sebelah side saja?
