bank lelong

kisahnya....

1. beli apartment
2. buat loan
3. payment cun for 5years
4. masuk pertengaha thn ke 6, payment sangkut
5. apartment tak diduduki & takde penyewa
6. dark area....nak jual pun payah
7. owner malas nak menten

soalannya....
nak jual tak laku, biar jek kena lelong.....
balance utang incl interest dlm 50k...loan 86k....(90% loan)
kalu apartment kena lelong dan harga lelongan tak blh cover hutang, owner sanggup keluar barang 10k utk settle the loan.
bila dah kena lelong, lepas hutang BUT.......ada sesapa blh explain KESANNYA?

nama kena blacklisted?
declare bangkrup ke?

kenapa perlu blacklist lak... kompem nama clear..

okk.....apa jdk plakkk selama aparment tuhh tak de bid.....apa status yg buat loan tuh? dah area tuhh kureng skit, org nak beli apartment lelong punnn takde.....

biasanya bid kot takder owg nak beli... harga akan jatuh... utk 2nd bid...
bila 2bid tak laku gak... sure rizab price akan drop lagi... hinggalaa ada buyer...


sebagai cth... ada antara rumah lelong yg di jual pada harga RM10k-12k jer kat bukit tak berapa nak UNTUNG..


dalam kes nie... pemilik lama kena bayar extra ler... utk clearkan nama dia semula..

ayoyoyo...kalu sampai 10-12k jekk baik sambung jekk bayo loan tuhh.....

btw, biler nama blacklist takde sampai ke bankrupcy ka? aku ni btuii buta bab2 camnie......

blacklist lain - urusan bank jer
bankrupcy lain - keputusan mahkamah
kalau mahkamah dah declare bankrupcy  for sure bank akan blacklist

tanpe belengah2, ahkak pon kol abg linggam...katanyer die presiden hakim/loyer semeleysia, kompom beliau hebat...kata beliau-

1. ape akan jd kalu loan defaulter da xnak umah die beli tuh...

ikut housing loan agreement korg...2 istilah, iaitu shortfall dgn concurrent...

shortfall: ialah di mana beng hanya akan saman defaulter selepas umah dilelong/dijual, belen outstanding tu br benk boley saman (kalu ade la)...

concurrent: di mana di samping beng mintak order kort utk lelong umah, beng jugak bley saman defaulter utk recover outstanding...so beng x pyh tggu umah lelong br nk saman defaulter..dlm kes ni, lps beng dpt judgment/penghakiman utk outstending amount, beng akan bleklisted defaulter...so defaulter x bley la nk apply loan laen...tp beng xkn prosid dgn laen2 prosiding execution sampai la umah plak berjaye di lelong...

dlm current housing loan agreement (after 90's), sumer nyer ade state psl beng bley pilih same ade nk prosid dgn shorfall or concurrent action...x caye korg bace balik agreement tuh...

2. umah di lelong, x berjaye dijual, abes cmne..

mmg kalu korg da x mampu baya loan, beng g kort mintak order for sale umah tuh...then kort fix bape rizep price, current value etc....

1st auction x de sape bid/beli, then beng reduce rizep price...tgk la bape kali auction janji bley kaver outstnding amount...or even x bley kaver outstnding, stil beng bley reduce rizep price, tp defaulter kene kaver/baya la belen yg outstnding tu...

tp xdek la karen velue RM100K beng nk jual RM1K, tu beng sndri akan rugi...sbb die pong tawu defaulter xkn mampu baya outstnding yg tggi tuh...so die ade la limit die...cnth die tetapkan...katekan value umah 100K, outstnding 70K...die fix paling min die bley reduce price ialah 60K...so katekan smpi ke auction rege 60K, xde sape bid/beli, besernyer beng sndri akan beli umah tu dgn rege 60K, so defaulter kene la baya belen 10K outsnding kpd beng...ape beng nk buat dgn umah tu jgn tanyer ahkak k...
