CLP, is it too difficult? Sometimes i feel sympathy with foreign grads but gov must be do something which can ensure the standard of lwyer can be maintained.

Year after year, theattorney-general himself has denied the existence of any form of quotafor the CLP and the relevant authorities have always explained thedeclining annual passing rate on the grounds that the standard orperformance of the candidates are too low.
I myself have hadto endure the heartbreak of failing CLP once, but I have many friends(who are no less competent than me and other newly qualified lawyers)who have had to take the exam up to four times before they finallypassed.
For those who do not know, CLP is compulsory for alllaw graduates of foreign universities before they can become aqualified lawyer here, whereas the graduates of local universities areexempted from it altogether after obtaining their Bachelor's Degree.
Therationale for the CLP exam is acceptable. Because foreign graduates donot study Malaysian law in their courses, they should be made to passthat exam in order to prove that they know enough about Malaysian lawto be a Malaysian lawyer. That is fair, and is necessary, to protectthe public from unqualified lawyers.
On that rationale,graduates of local universities are exempted from sitting for andpassing the CLP, presumably because they have studied Malaysian lawthroughout their Bachelor's Degree course, so they don't have to provethat they know enough about Malaysian law to be a qualified lawyer.
My question to the authorities is:
Sincethe local graduates studied Malaysian law much more than the foreigngraduates, and they have been deemed qualified enough in Malaysian lawby the respective universities which awarded them their degrees, surelythey would have no problem whatsoever in proving their competence bypassing the CLP exam?
In fact, based on that rationale, theyshould be guaranteed to do better than the foreign graduates (whonormally only attend courses at private colleges for about nine monthsbefore taking the CLP exam), since they have studied Malaysian law forfour long years. And if they can抰 be guaranteed to pass, then theremust be something seriously wrong in local universities sending outunqualified lawyers to misguide the public and pose a threat to thelegal system, year after year.
If the foreign graduates arerequired to prove their competence, so should the local graduates.There is absolutely no justification for inequality or preferentialtreatment when it comes to proving your professional competence.
Therefore,to eradicate all suspicions of foul play and unfair practices whichhave dogged the CLP for so many years, why not make all law graduates 杅oreign and local |

Dato' Seri,
Adalah dengan kesalnya saya membaca laporan akhbar baru-baru ini mengenai kes bekas pengarah peperiksaan Sijil Amalan Guaman (CLP) Khalid Yusoff yang disabit kesalahan menipu. Menurut laporan tersebut, wujudnya kuota bumiputera peperiksaan CLP dan juga tahap kelulusan adalah dikawal pada kadar 30-35%.
Sebagai seorang yang berbangsu Melayu, saya berpendapat adalah amat memalukan bahawa Lembaga Kelayakan Profesion Undang-Undang (LPQB) mengamalkan polisi tersebut. Ini adalah satu tamparan kepada martabat orang Melayu kerana ia seolah-olah menunjukkan bahawa orang Melayu tidak mempunyai kebolehan langsung sehinggakan kita terpaksa menghalang orang lain daripada melangkah ke hadapan demi kemajuan kita. Ini berbeza daripada sistem kuota lain di Malaysia di mana orang Melayu cuma diberi kelebihan, tetapi orang bukan Melayu tidak dihalang daripada menceburi bidang masing-masing dengan daya usaha sendiri.
Selain daripada itu, apa yang lebih mengejutkan adalah kenyataan Peguam Negara Tan Sri Abdul Ghani Patail yang dipetik dalam media pada bulan Oktober tahun lepas sebagai berkata bahawa tiada kuota untuk peperiksaan CLP.
Saya berpendapat kenyataan tidak benar Peguam Negara itu adalah kelakuan melanggar tingkah laku yang amat serius dan tidak sepatutnya terjadi. Oleh yang demikian, saya meminta Dato' Seri mengarahkan beliau untuk memberi keterangan lanjut dan terbuka mengenai hal tersebut dan jika penerangan adalah tidak munasabah, maka dia perlu meletak jawatan ataupun dilucutkan daripada jawatan tersebut.
Saya juga berharap bahawa LPQB diarahkan agar menghentikan amalan kuota dengan serta-merta dan memastikan bahawa segala skrip jawapan peperiksaan CLP mulai peperiksaan 2007 yang baru tamat ini, disemak dengan penuh munasabah, cermat dan adil dan memastikan bahawa faktor-faktor yang bukan rasional tidak digunakan dalam penyemakan tersebut. Ini termasuk sama ada calon CLP telah menduduki peperiksaan tersebut sekali atau lebih mahupun bangsa, agama, jantina dan sebagainya.
Dato' Seri, negara kita sedang mengalami satu masalah yang amat serius iaitu kehilangan golongan yang berpendidikan dan berkemampuan tinggi. Ekonomi Malaysia tidak dapat dibina dengan bertepuk sebelah tangan sahaja.
Pembabitan semua golongan masyarakat Malaysia adalah amat penting untuk memastikan Malaysia menjadi sebuah negara maju. Walaupun saya menyedari hakikat bahawa terdapat orang Melayu yang ketinggalan dalam beberapa aspek, saya berpendapat bahawa adalah tidak wajar jika orang Melayu diberi bantuan secara membuta tuli dalam setiap aspek, tetapi sebaliknya dengan rasional dan dengan membuat kajian terperinci tentang kesan bantuan tersebut, terutamanya sama ada bantuan tersebut akan betul-betul membantu orang Melayu secara positif ataupun cuma melalaikan mereka.
