Court finds Utusan article ‘mischievous’, awards Karpal RM50k By Clara Chooi Assistant News Editor December 14, 2012 KUALA LUMPUR, Dec 14 — A High Court here awarded Karpal Singh RM50,000 in damages today after finding Utusan Malaysia liable for defamation over a 2008 article where it quoted the DAP chairman as rejecting Islam. High Court judge Nik Hasmat Nik Mohamad, when reading out her judgment this morning, said although the Malay-language daily had retracted and apologised within 24 hours of the said publication, the article had subjected Karpal (picture) to a certain degree of public contempt and ridicule. She added that the date of the publication on August 25, 2008 — one day before the Permatang Pauh by-election — and the fact that it was carried in the mainstream media was “by all accounts mischievous”. “In view of the fact that the plaintiff is a leader in the Pakatan Rakyat (PR) coalition, and the timing of the article’s publication, it may be interpreted that it (the article) was calculated to jeopardise the chances of a victorious outcome,” the judge said. Karpal had filed a RM10 million defamation suit against the Umno-owned Utusan Malaysia in 2008, claiming he had been misquoted in an article written by the publication’s news editor Zulkifli Jalil. The article, headlined “DAP diingat jangan bakar perasaan Melayu”, was based on Karpal’s speech at the DAP’s 15th national congress that year where Zulkifli purportedly wrote that the politician had rejected Islam as the country’s official religion.
