[Tempatan] Section 509 Penal Code: Patut kah pelajar2 rekod dan "share" bideo pensyarah perempuan UiTM itu menghina pelajar B40 semasa kelas atas talian.?

PETALING JAYA: Social media users are reminded to refrain from recording and sharing any form of videos or photos of a third party without their consent.

Lawyer Nur A’minahtul Mardiah Md Nor said those caught recording and sharing videos or photos of someone without their permission can be charged under Section 509 of the Penal Code.

She said under the law, anyone with intent to insult the modesty of a person, utters any word, makes any sound or gesture, or exhibits any object with the aim that such words or sounds shall be heard, or that such gestures or objects shall be seen by a person, or intrudes on the privacy of a person, shall be punished with a prison term of up to five years or a fine, or both.

“I would like to remind all social media users to refrain from spreading photos or videos of any person without their permission or consent,” she said.

Nur A’minahtul was commenting on an incident involving a student who allegedly shared a video of a public university professor berating another student during an online class.

Other social media users were quick to spread the video and made hurtful comments against the professor, claiming her choice of words were insulting to low income earners.

However, after a thorough investigation by the university, it was revealed that the student the professor was speaking to was not the one who shared the video online.
“The student did not know about his classmate’s intention to spread the video nor did he agree with the action,” the university said in a leaked report following the investigation.

Attempts by theSun to contact the university’s vice-chancellor and corporate communications department were unsuccessful at press time.
Sources close to the university confirmed the vice-chancellor was no longer issuing comments on the incident as the matter was now in the hands of the Higher Education Ministry for further action.

Benar kah cakap peguam di atas tentang kes pensyarah UiTM itu.?  Mengikut Undang2, benar kah pelajar2 B40 UiTM tak boleh bongkar kelakuan jahat pensyarah2 terhahap pelajar2 B40 di socmed.?

... Kalau benar, orang2 awam tak boleh rekod dan share bideo yang mempamerkan  kelakuan jahat pelanggar2/pesalah2 Undang2, spt orang2  yang tak pakai pelitup muka di tempat awam, peragut, perompak/pencuri, perasuah, perogol, pencabul seks,  penzina, pesalah trafik, penculik, pembuli/pemukul, pembunuh, gengster2 kongsi gelap, scammers/penipu dan penjenayah2/pesalah2 lain.   Kalau ini macam, Section 509 Penal Code bertujuan melindungi pesalah2/penjenayah2, bukan mangsa2 mereka = mungkin peguam ini Melayu liberal macam puak PKR dan Amanah.

Puak liberal dari "Blue States" di USA/AS juga menyokong perusuh dan pencuri/"looters" BLM (Black Lives Matter),  pendatang haram Hispanic (spt dari Mexico, Honduras, Guatemala, dll), pengamal seks luar tabii (dan luar tahi.?), penghapusan hukum mati, dll kerana nak memancing undi untuk kalahkan pihak konservatif dari "Red States" di PRU.

Kalau pihak berkuasa atau atasan, spt PDRM, Kementerian, UiTM, syarikat, dll, enggan mengambil tindakan terhadap pesalah2/pelanggar2 Undang2 atau Peraturan2 setelah dilapurkan oleh mangsa2, mangsa2 hanya boleh diam dan terus dimangsakan kerana mangsa2 dilarang membongkar kelakuan jahat pesalah2 melalui rekod dan "share" bideo di socmed. Patut kah.?

PETALING JAYA: The UiTM lecturer who was caught berating a B40 student during an online class for not owning a laptop has been put on leave from her teaching duties.

According to the varsity in a statement released on Friday (April 1), the lecturer will be on leave starting Friday (April 1) until the investigation is completed by UiTM.

“The decision was made to ensure the investigation is conducted effectively and orderly,” the statement read.

It said the varsity would strengthen the role of its lecturers and improve its teaching policies and ethics at all levels of study

Assessments and monitoring of lecturers' professionalism which are conducted randomly each semester, UiTM said, could become an additional element in promotion processes and in the extension of service contracts.

“The varsity also views the intentional or unintentional dissemination of confidential information that may be detrimental to the image and reputation of the university and threaten the safety of our residents and staff seriously.

“UiTM will not hesitate to take firm action and report to the authorities if there are parties who share misleading posts,” it added.
