KIRAAN ANNUAL LEAVE

bb nak mintak pendapat yg arif lam HR - kiraan AL. nak taw u all kira camne.

kisahnye bb baru take over HR and dok belek2 kiraan AL depa nih..ade sikit pening la cam xseragam jek..ke haku yg xreti kira?

yg bb perati general rule dia lebih kurang gini ler

- belum confirm no cuti at all *(kalu apply kene potong gaji)
*bb ade terbaca kat lam law journal, company sebonarnye xleh sukasuki potong gaji for leave without writen consent, what say u?)

- kalu da confirm, coti setat d next month (lbh kurang) say confirm DOJ bulan 1/09, DOC 03/09, so kiraan coti setat 04/09.
Contoh - AL entitlement 10 hari = 10hari/12bulan x 9bulan =  7.5hari (pro rate for 2009)

ni berdasarkan lam file kiraan depa :

1) kes pertama
DOJ 20/01/09
DOC 04/05/09
leave entitlement - 10 days completion of 1 year, 14 days 2nd year

coti after confirm may 09 (may till dec 8 bulan) = 10 hari / 12 bln x 8 bulan = 6.6 (6.5 days) - yang ni mmg betul lam fail nye..

so berdasarkan kiraan atas aku kira la yg bawah nih..tapi lain dapatnye..

2) kes kedua
DOJ 07/07/08
DOC 24/02/09 (6months)
leave entitlement - 10 days completion of 1 year, 14 days 2nd year

so coti dia after confirm february 09 (feb till dec 11 bulan) =
10 hari /12 bulan x 11 bulan = 9 hari
tapi, kalu ikut bulan keje, bulan 12 dia da cukup satu tahun. so coti dia da naik 14 hari
14 hari / 12 bulan x 11 bulan = 12.5

tapi rekod dia tunjuk utk this year ade 11 hari jek coti. camner kira tuh?

3) kes ketiga
DOJ 03/11/08
DOC 24/02/09
leave entitlement - 18 days 1st-5th year

so coti dia after confirm feb 09 (feb till dec 11 bulan) =
18 hari / 12 months x 11 months = 16.5 days

tapi rekod dia tunjuk 15 hari jek..ciss..tah pepe kira..

yg arif, sila tunjuk ajo please

lupa nak add. bb biase kat company dulu kira AL simple jek. If DOJ 01/09, DOC 03/09 - kiraan dia bb amik trus 01/09 sbb da mmg pun dia complete that 3 months kan, so kalu kira dr bulan 4 da shortchange plak rasenye that 3 months dia.

so for that year i would consider dia dapat la 10 hari (provided koje sampai 12/09 ler)

bb,

shida punya kiraan.

start 1/3/09
confirm 2 bulan kendian kan
cutinya let say setahun 14 hari
so 14/12 x 10 = 11.6 hari
dia start joint je dah entitle cuti cumanya dalam tempoh probation kalau nak cuti memang kena potong gaji. kat sini we all practice cuti ikut entitlement. tak boleh advance cuti. kalau cuti sehingga hujung tahun ada 6 hari, tapi entitlement 0 maka kena apply unpaid leave.

tapi cuba le tanya pada pakar HR yang lain.

macam ur kes, shida punya trainer pun dia kes yang sama jugak. bila dah confirm baru dia entitle untuk cuti tahunan.

2 bulan confirmation tu based on my co tau

sama la shida, i would have calculated cam shida gak. sbb lam act xder pun kater probation bagai, dia specify cukup 12 bulan dapat sekian-sekian cuti, although mmg standard praktis kalu dalam probation xder coti, kene unpaid.

pada bb la, salah kalu dia wat kira camtu. kira bulan2 sebelum confirm da burn gitu jek, xrecognise pun kite keje kat company macam tak aci la plak kan. bb byk berpandu pada employment act jek walau yg gaji lebih rm1.5k, for general rule. senang gitu. tapi kat sini bb tgk, gaji RM1.5k lebih ker kurang ker..depa belasah seme wat kira gini.

anyone else ade pengiraan lain ke? ke firm sini jek wat kira gini?

camner nak cakap eh, kalu ikut undang2 AL ni bukan la hak penuh, ia bergantung pada discretion of majikan. majikan bule tolak application kalu dia rase memudaratkan operasi company. general rule, kalu da submit leave form, bebawak la pastikan ianye approve sebelum go on leave kang tak pasai2 kene cop langgar contract lak.

panjang lagik argument yg bb bace lam law jounal aritu..hehehe..nanti2 kot free bb share2 for info

Wahh...byk lagi balance cuti tu....tp leh carry forward tahun depan tu tak kalau cuti end of the year masih berbaki??

Wah...kene bg spesifik reason la plak...so kalau camtu ko bg la spesifik reason...walaupun reason tu tak betul....

eh tak la shida, bb ni cam bidan terjun, bertaun2 belajar sikit2 sendiri jek. tu pasal bb masuk sini, nak mintak tunjuk aja gak pada yg arif. usually bb kalu xsure akan rujuk buku2 or call trus labor office gitu. la ni attached to legal firm, kalu ade in legal journal cases berkaitan HR bb bace je pastu ask d lawyers if not sure..

bb pun nak mintak tunjuk ajar shida..heheheh

heheheh..konpius ker? mmg ler lam kes2 kat atas tu lain cotinye sbb lain pangkatnye. rasenye yg tu tak jadik masalah, yg jadik masalahnye adelah formula pengiraan pro rata coti tu sendiri.  kat sini, kekdahnye selagi tak confirm dianggap tiada cuti, pro rate bagai pun tadak.

bila da confirm, baru la dia akan kira cuti pro rate for the current year tapi bukan berdasarkan DOJ, berdasarkan DOC. kiraan bermula the month diconfirmkan (rujuk kes pertama)

yang pertama nye soklan bb, adakah wajar pengiraannye begitu? sbb kira bulan2 sebelum confirm dia tak kira, burn gitu jek. kalu masuk bulan 1, confirm bulan 3 - bulan 3 tu baru dia "acknowledge" keujudan staff tu.

yang kedua nye soklan bb, kalu rujuk kepada kes pertama, straight forward la kiraan dia kan, lam fail staff pun mmg itu la jumlah cuti nye. tapi bila bb cube apply formula dia yg sama pada staff lain (kes kedua & ketiga), jumlah pro rate cuti tak sama dgn yg direkodkan dalam fail.

bile teliti, bb rase for 2 kes kendian tuh, dia amik bulan selepas diconfirmkan - cth confirm bulan 3, kiraan bermula bulan 4 gitu.

haa..lebih kurang gitu la persoalannye. yg bb nak bincangkan adakah wajar kiraan sebegitu, sbb bb mmg tak setuju bulan seblm confirm tu tak di ambil kira langsung. mmg betul kita tak perlu kasi dia coti, but lepas da confirm tu kenapa tak include kan sekali kiraan nye.

bb nak seragamkan mende nih xkira la gaji 1.5k below ker above gitu so senang. sok2 kalu bb tak de pun org lain bule take over. tu yg nak minta pandang kat sini.

seme pun jauh! hik hik hik hik, tapi da tgk gak course2 kat situ. yg ade weekend tu la rasenye target bb. if dapat saturday one full day pun lagi cantik. masih lagi dok tolak campur congak bagai..

go back to the staff code (SC), letter of appointment (LA) atau collective agreement (CA).

a.  unpaid leave during probation, rasanya general practice dan ada included dalam SC, LA atau CA.
b.  mungkin kiraan cuti tu, kampeni tak berkira sangat pasal days.  
sebab tu untuk kes 1), dia kira 8 bulan.  
sebab tu untuk kes 2), mungkin hr buat pro-rate untuk 4 bulan for 10 days annual leave dan pro-rate 6 bulan untuk 14 hari annual leave.
sebab tu untuk kes 3), kiraan ialah 10 bulan, bukan 11 bulan seperti pemahaman kau.
