Was it necessary to make it 'disappear'? In future... saya fikir tak payahlah pindahkan soalan
ke sini. Biarlah soalan tu di tempat asal. Boleh juga orang lain bagi pandangan masing-masing.
I also appreciate what you have done. You have given me the opportunity to test my own
knowledge and see how far I can go.. it's amazing how much I know and yet didn't realise
that I know what I know until the questions are posed to me and I found myself responding
with ease.. I don't know what came over me when I extended the invitation that day. Perhaps
I was just feeling bored with doing the same thing over and over again, day in and day out,
that I simply needed something new and challenging to tackle :bg:

Can't moderators also assist to answer questions? Please forgive my ignorance on your do's and don'ts here.. I'm new at Cari Forum.. but I am active in another forum.. US-based.. and the moderators there do help out to respond to queries and also start new threads with factual information.
P.S. Just discovered that moderator fairy_hobbit is also a lawyer.. thus the 'edit'

sebenarnya macam ni
tuan rumah memang nak jual rumah tu
but kitaorg taknak beli lagi
ingat setahun dua lagi baru mampu nak beli
but he needs money, let say around 50k
balance ngan bank ada lagi 130k
so dia jual 180k
since kami takde duit to give him 50k
dia buat refinance, atas nama dia la kan 180k
kaedahnya sekarang, he got that 50k, and settle bank loan tu
but hutang ngan another bank 180k
so hutang baru ni la yg akan kitaorg setelkan
but nama rumah tu still nama dia
mmm nak buat canne ekk?

How did you end up agreeing to that? Kalau tak ada written agreement..
masih ada legal contract.. jika dapat dibuktikan bahawa elemen-elemen
berikut wujud:
1. Tawaran (offer)
2. Penerimaan (acceptance)
3. Balasan (consideration)
4. Keupayaan (capacity)
5. Niat (intention)
6. Ketentuan (certainty)
7. Kerelaan Bebas (free consent)
8. Tujuan yang sah (valid object)
Kak Liza nasihatkan ina supaya menulis apa yang dijanjikan dan meminta orang
yang menjual rumah itu tandatangani sama.. di hadapan saksi.. dan minta saksi
tandatangan juga.
Kalau tak ada perjanjian bertulis payah nanti ina nak buktikan bahawa kontrak
itu wujud. Bukan tak boleh.. tapi payah..
Simpan semua resit bayaran ansuran yang ina buat kat bank.
Failkan kaveat di pejabat tanah untuk menjaga hak ina. ina beli rumah kan..
bukan apartmen?
Kalau sewa-beli pun.. ada sign agreement kan..?
Setahu kakak, sewa-beli untuk barangan mudah alih.. bukan hartanah.

SALAM PN LIZA,
Berbelas tahun yg lepas, ayah saya ada membuat perjanjian jual tanah gunakan khidmat peguam.Sekarang ni ayah saya sudah takda peguam tu dah arwah ke tidak saya pun tak tau...orang yang beli tanah ayah saya tu dah arwah juge....... Dengar cerita dari abang saudara saya tu,deposit sudah diberi, entah betul, entah tidak saya pun tak tau.. sebab dia tu jenis puuuuutarrrr alammmmmm.......Saya ada tengok dalam paper peguam tu dah digantung khidmat guamannya,saya ada juga cari2 pejabat peguam tu kat shah alam...tak jumpe pun....mana dia pegi errr.....?
Jadi, macam mana dengan perjanjian tu ? Minta maaf saya tak simpan surat tu,abang saudara saya yang simpan.
