Bile tgk tindakan yg perempuan ni buat hingge menyebabkan kematian +susahkan org lain dia bukanle oku tahap biase yg boleh dibiarkan sendirian kalau betul oku  |

Tak jugak bang..kalau tengok pada s.44(1) road trafic act yang si ahmoi ni dicaj..:
Driving while under the influence of intoxicating liquor or drugs
44. (1) Any person who, when driving a motor vehicle on a road or other public place— (a) is under the influence of intoxicating liquor or drug, to such an extent as to be incapable of having proper control of the vehicle; or
(b) has so much alcohol in his body that the proportion of it in his breath, blood or urine exceeds the prescribed limit, and causes the death of or injury to any person shall be guilty of an offence and **shall, on conviction, be punished with imprisonment for a term of not less than 3 (three) years and not more than ten years (10) and to a fine of not less than eight thousand ringgit RM8000 and not more than twenty thousand ringgit.
Kalau sabit salah, penjara 3-10 tahun DAN denda dari rm8000-rm20k..
Dua-dua kena, bang...penjara DAN denda selain lesen juga digantung tak kurang dari lima tahun...

Org adhd ni sebu if dia constantly mkn ubat & ikut therapy elok2 boleh je fikir mcm org normal. I tgk anak kwn i bila makin besar dia nmpk makin normal lah. Takde la mcm time dia bdk2 dulu kan. But she was diagnosed with adhd seawal umur 5yo, so mmg dari awal dah pergi theraphy jumpa doctor pakar dkt hukm. Ubat mmg tak putus.
So mcm amoi ni, maybe la waktu dia apply for driving license dulu dia lulus segala test & condition yg jpj tetapkan. Agaknya waktu tu dia mmg elok mkn ubat & dpt good recommendation dari doctor dia. Now ni dah besar, dah bergaul dgn kengkwn jadi lain la agaknya. Terlupa mkn ubat ker, or maybe teroverdose ubat pun ada jugak.

Betul agree. Kalau di klinik psikiatri ada ubat ubat yg clearly tulis causing drowsiness bla bla bla. Do not drive operate heavy machinery ke apa camtulah. |

Actually, OKT PG atau tidak pada peringkat pertuduhan dibacakan tidak memberikan impak yang begitu besar pada pengakuan OKT tersebut memandangkan saringan urine di buat di pejabat narkotik.
After laporan urine balik dari Jabatan Kimia and confirm positive ampth then the Defense counsel would have to prove that the drug is part of her medication or not. |

Setuju aku dgn kate2 kamu juliez sdgkan syndrome down pun ade yg hidupnye boleh berdikari tanpe bantuan ahli keluarge dah bile diberi perhatian dan treatment secara betul. Iye mungkin juge amoi tu bile besar family mule kurang perhatian dlm rawatan sb boleh berdikari sendiri. |

GEORGE TOWN: The woman involved in a six-vehicle crash in Penang which killed a technician yesterday, should be investigated for murder.
This was the opinion of law lecturer Shamsher Singh Thind, who said this incident was not an ordinary case of causing death due to reckless or dangerous driving.
"This is murder.
"I call upon the police to investigate the death of Mohamad Fandi Rosli, 26, under Section 302 of the Penal Code, and not under Section 41(1) of the Road Transport Act 1987," he said.
In the 7.50am incident, the woman, 19, believed to be drunk and high on methamphetamine, drove her car at high speed against the flow of traffic along the North-South Expressway (NSE) after the Sungai Dua toll on mainland Butterworth, and triggered a multiple vehicle collision.
Her Proton Gen 2 struck the Perodua Kelisa driven by Fandi, which led a chain of other collisions.
Fandi died on the spot due to severe head and bodily injuries.
The woman and four other vehicle drivers escaped with minor injuries.
Elaborating, Shamsher said, according to Section 300(d) of the Penal Code, culpable homicide is murder if any person, committing an act that causes a death, knows that the act is so imminently dangerous that it must in all probability cause death, or such bodily injury as is likely to cause death, and commits such act without any excuse for incurring the risk of causing death, or such injury as aforesaid.
Shamser said for example, if someone were to fire a loaded cannon into a crowd and it kills someone, then the person who fired the weapon is guilty of murder, regardless of whether there was intent to kill anyone.
"In the case before us, driving in an opposite lane at 110 km/h is as dangerous as firing a loaded cannon into a crowd.
"Now, the woman driver, has any defence which is recognised by the law (like she was drugged involuntarily, or she was escaping from some other danger) is irrelevant at this investigative stage.
"She may rely on it during the trial later, but for now, the investigation should be conducted as if a murder has been committed," he added.

Ok..katakanlah from medical expert menyatakan si ahmoi ni jadi blur alah gitu disebabkan kesan ubat yang dia ambil utk AHDH nya itu, adakah dia sama levelnya dengan intoxication yang menjadi salah satu defence dalam kes criminal..?
