Altantuya’s father upset over acquittal, wants Mongolia to intervene

The father of Mongolian Altantuya Shaariibuu is upset with the Court of Appeal's decision today to acquit the two ex-Malaysian policemen who were charged with her murder.
News portal MalaysiaKini contacted Setev Shaariibuu through a Mongolian lawyer but the man refused to give a statement and only said, “It is time the government of Mongolia make a statement about this."
The report quoted Mongolian lawyer Munkhsaruul Mijiddorj as saying his client expected the verdict and felt that he must now take the case to a higher level to seek justice for his daughter.
Earlier, Setev's lawyer Karpal Singh told The Malaysian Insider that he would file a civil suit over Altantuya's murder that happened on October 19, 2006.

DAP wants independent inquiry into prosecution’s conduct in Altantuya case

The DAP has called for an independent inquiry into the conduct of the prosecution in the trial of two former policemen charged with the murder of Mongolian Altantuya Shaariibuu.
The call came after the Court of Appeal freed former chief inspector Azilah Hadri and former corporal Sirul Azhar Umar of the murder charge, where one of the grounds of acquittal was the failure of the prosecution in calling DSP Musa Safri to the stand.
Musa was the aide-de-camp to Datuk Seri Najib Razak who was then deputy prime minister and defence minister.
DAP national legal head Gobind Singh Deo (pic) said the Attorney-General and his team ought to have known that Musa was an important witness.
"They have, one would assume, vast experience in handling cases like these and they know for a fact that they would run a serious risk of having their case thrown out for failure to call important witnesses.
"So why did they choose to take the risk, which has now come to serve as one of the reasons for the collapse of their case," said Gobind.
He added that this gave rise to questions whether there had been proper investigations and a proper presentation of evidence in court.
"We cannot allow these concerns to go unanswered. There must be an independent inquiry, by people who are not associated with the AG's Chambers to review the investigation papers and to report back as to the propriety of the conduct of the prosecution," he said.
In calling for an independent inquiry, Gobind added that the powers-that-be must always ensure that the public has full confidence in the AG's Chambers.
Azilah and Sirul were jointly charged and convicted by the High Court in Shah Alam in 2009 for murdering Altantuya, 28, at a forest reserve in Shah Alam in October, 2006.
They appealed, and were set free by the Court of Appeal today. - August 23, 2013.

Karpal to call PM and ex-aide in Altantuya civil suit
Senior lawyer Karpal Singh will apply to call Prime Minister Najib Abdul Razak and his former aide de camp DSP Musa Safri in the RM100 million civil suit arising from the murder of Mongolian national Altantuya Shaariibuu.
Speaking to reporters in Shah Alam, Karpal (left), who is representing Altantuya's family, said he will re-activate the suit, which has been pending until a decision is made by the criminal court.
He said although the acquittal of the two policemen by the Court of Appeal this morning may have a bearing on the civil suit, the case would be decided on a balance of probabilities.
"Like the (former American footballer) OJ Simpson's case, although he was acquitted, the civil suit found him liable (for his former wife's death).
“We will call Najib and also Musa to link the circumstances leading to Altantuya’s death. Musa could not have acted on his own in this matter. There is still a chance of establishing guilt on somebody’s part,” Karpal said.
He said the Altantuya murder was serious matter, for a foreigner had come to the country and got blown up and nobody is now liable for the killing, following the acquittal of the two former Special Action Force (UTK or Unit Tindakan Khas) by the Court of Appeal.
Neither Najib nor Musa were called in the trial, despite suggestions and speculation being made that Altantuya had played a role in Malaysia's purchase of the two Scorpene submarines through a company owned by political analyst Abdul Razak Baginda.
Abdul Razak, who was charged with abetting in the murder, was acquitted by the High Court without his defence being called.

‘Prosecution did badly’
The non-calling of Musa was one of the points raised by defence counsel Kamarul Hisham Kamaruddin, who took the position that this was fatal to the prosecution’s case.
The Court of Appeal judges in their judgment today said the non-calling of Musa had created an adverse inference in the prosecution’s case.
Karpal said while he was glad the prosecution would be appealing today’s decision, its handling of the case was “not up to the mark”.
He said as lawyers holding a watching brief for the family in the case, they were limited to the things they could do.
“Although we wanted to see Najib and Musa being called, this was not done by the prosecution. Nevertheless, we may have a chance in the civil suit,” he said.
However, Karpal admitted that the civil suit may have to wait until the prosecution’s appeal against the acquittal is decided by the Federal Court.
He said he would try and contact Setev through a Mongolian translator to get further instructions on the matter.
Azilah and Sirul were acquitted by the Court of Appeal today after it found serious misdirections to have been committed by the High Court trial judge.

Setev very upset, wants Mongolian gov't to intervene
Setev Shaariibuu, the father of murdered Mongolian national Altantuya, is very upset with the Court of Appeal’s acquittal of the two ex-policemen charged with her murder in October 2006.
Setev declined to issue a statement beyond saying, “It is time the government of Mongolia makes a statement about this result.”
It is learnt that Setev had expected the verdict and now feels he must take the case to a higher level, to get justice for his murdered daughter.
His immediate response was relayed to Malaysiakini via his Mongolian lawyer Munkhsaruul Mijiddorj.
Munkhsaruul said Setev planned to seek the assistance of the Mongolian government in the matter.
“He will make a statement after getting an official letter from the Malaysian court or from his Malaysian lawyer Karpal Singh,” she said.
“He is also awaiting further advice from Karpal, who is holding a watching brief in the case, on how to proceed,” she added.
Setev, who is in his 60s, has filed a RM100 million civil suit, which has been pending since 2007, against powerfully connected Abdul Razak Baginda, ex-policemen Azilah Hadri and Sirul Azhar Umar, and the government over the circumstances surrounding Altantuya’s death.
Abdul Razak, who was charged with abetting in Altantuya's murder in 2006, was acquitted in 2008 without his defence being called.
Setev filed the suit to seek financial compensation for the loss of Altantuya on behalf of his wife, and two grandchildren now aged 17 and 10.
The Court of Appeal today freed Chief Inspector Azilah Hadri and Corporal Sirul Azhar - who were Special Action Unit officers and former bodyguards of Prime Minister Najib Abdul Razak - of the murder.
Karpal said the civil suit may have to wait until the outcome of the prosecution’s appeal over the acquittal in the Federal Court.
