3 Months Notice

Tempat kerja haku kena serve 3 months notice kalo nak resign. 3 months is a bit too much, sebab kalo haku dapat kerja lain pon sapa yg sanggup tunggu 3 bulan? Syarat skarang, either 3 months notice or 3 months payment in lieu.

Haku terpikir nak buat camnih :

Either

a) negotiate direct utk dapat 1 bulan notice; and kalo haku fail...

or

b) bagi notice 3 bulan, sebulan tuh haku buat hand over, after that haku lesap or "buat perangai". Bila haku "buat perangai" (MC, ponteng, masuk lambat lepas tu lesap etc) kompeni would take disciplinary action, and kalo depa terminate haku depa kena bayo kan? :hmm:

Any comments and suggestion how to escape this 3 months clause?

1. almost 109% akan fail...:nerd:

2. kalu ko yg wat prangai lps tender resign letter, pesal plak kalu co terminate service ko diorg kene baya?...:jeling:...diorg ade legal basis per utk terminate service ko...kalu ko bercadang nk wat prangai, ko kene check jugak kat offer letter/contract ko clause2 ape akan jd kalu ko wat prangai mase service period...x silap haku salunyer kene explain/letter tnjk sebab etc...kalu diorg tgk mmg ko saje wat perangai mmg diorg leh terminate service ko...msti ade tulis dlm kontract ko kalu ko dibuang sbb ko sndiri wat prangai....kalu co stil kene baya damages lps employee dier wat prangai, best la employee kan...:pmuka:

hmmm....ko ada apa apa cadangan utk haku lepaskan diri dari kuku besi 3 bulan nih? haku dah melepas byk peluang kerja sebab notis 3 bulan nih :geram:

mcm ade sorg mmber aku, pon kene bg 3 manth notice...tp mcm dier ok la, co yg dier nk apply lps tender resign tu sanggup tggu dier...so lps tender stil dier wat keje cam biase utk 3 bulan tuh...

issh..company apa kena bagi notis sampai 3 bulan ni ? important sgt ke kamu punye post tu ?issh...issh..CEO kot...
cuba negotiate dgn bos, kalau masih ada balance annual leave, cuba off set, mungkin boleh bayar the balance 2 months in installment ke....after all, they are human too...kalau bank boleh accept installment payment, takkan depa tak buleh kot...
kalau buleh jgn 'lesap' je...record tara baik woo..future employer buleh check dgn EPF maa...nak-nak lagi kalau dpt company yg suka buat reference check ni...
he..he..akak memang buat reference check punya...mesti !!!

syarikat aku dulu pun mintak notis 3 bulan
jadi apa aku buat ?

. sbl aku kasik notis .. aku carik kerja yg boleh beri 5 kali ganda gaji sampai dapat ... alhamdulillah dapat
. aku pulun kerja sampingan
. aku kasik notis 1 bulan setengah
. gaji bulan terakhir .. 1 bulan aku suruh admin 'hold' .. jgn kasik aku
. lepas sebulan keluar dr. pejabat lama ... aku tambah 1/2 bulan gaji tunai kat bos lama aku
. selesai

nasihat aku :
. semak surat tawaran dpd syarikat sbl tandatangan
. semak surat pengesahan jawatan sebelum tandatangan
. nyatakan apa hak hak anda sbg pekerja .. dan hak sbg majikan
. elakkan 'buat perangai' .. tak profesional

amacham bro ? ... orait ?

normally kita akan check whether si candidate bagi notis ke idak, lari camtu je ke..
kerja ok ke tidak....any disciplinary action taken, any misconduct, a little bit of behavioral interview.

normally akak akan call the hr dept to verify because they are supposed to be the third party and not allowed to take sides...so I can get a better picture.

reference check ni selalunya dibuat selepas candidate came for the interview. kadang-kadang akak buat police reference juga tau!

nie cnth care baek utk blah dr co...point: ilang last manth salary, kene baya 1/2 month gaji kpd co...

skangni ribas nk tau mcm mane nk blah dr co tu dlm mase lebih kurang sebulan la, kalu buleh dier x pyh baya ape2 kpd co tu, at the same time co tu x buleh wat ape2 tindakan/sue etc against him sbb breach contract ke hape.....:pmuka:

dalam offer letter aku, takde sebutpun pasal termination of service, nak kasi berapa bulan notis. So aku bg 4 minggu notis sebab dalam akta kerja ada tulis... sekiranya tempoh notis x dinyatakan dlm kontrak perkhidmatan,  tempoh notis hendaklah seperti berikut:

4 minggu notis jika pekerja telah bekerja kurang daripada dua tahun.

6 minggu notis jika pekerja telah bekerja 2 tahun atau lebih tetapi kurang daripada 5 tahun.

8 minggu notis jika pekerja telah bekerja 5 tahun atau lebih.

Dah puas aku bincang dgn org lain brp lama aku nk bg notis, puas cari kt internet...so aku refer yg ni lah.

Terms and conditions dlm HR Handbook

2.8 Termination of Employment

Notice of Termination                                Notice Required

Management Staff               - within one year of service        1 month's notice
                  - more than one year of service        3 month's notice

Non-Management Staff                                1 month's notice

Temporary/Part-time Staff                                Subject to Management discretion

All notice of termination must be writing and to be submitted to your immediate superior and/or manager for acknowledgement. The letter will then be submitted to Admin/Personnel Department for processing. In the event of termination without sufficient notice, the termination party must pay to the other party an equivalent in salary in lieu of notice. All resignees are required to return all company items on their last day of work. Information acquired during the course of employment should be kept strictly confidential.

2.9 Adherence to Rules/Regulations

Employees shall act or perform their work in strict compliance with all the Company's Rules and Regulations at all times during working hours or whilst in the premises of the Company.

2.10 Misconduct

Disciplinary action will be taken if, after due enquiry an employee is found guilty of breaching any of the Rules and Regulations or any other misconduct which are not acceptable to the Management. Severe action including dismissal may be taken and under such circumstances, all benefits will be forfeited.

2.11 Exit Interview

All staff leaving the company is required to attend an exit interview with the Personnel Manager/Officer. Such information obtained will help us to understand better the needs of our employees and to improve our working environment, if necessary.

2.12 Absenteeism

If an employee has been continuously absent from work for more than 3 working days without:

a) prior leave or reasonable excuse, or
b) informing or attempting to inform his/her superior,

The employee is deemed to have breached the contract of service. As a result, he/she is required to pay the Company a salary in lieu of short notice. If payment is not forthcoming, the Company has no other alternatives but to take further actions, which may result in legal proceedings.

dr terms contract ko tu, yg aku prasan:-

1. ko kene bg 3 manths notice..
2. buleh baya money in liew notice
3. any misconduct, co buleh dismiss ko..
4. kalu ko absent....blalala tuh (wat prangai la) ko dikira breach contract, ko kene baya co utk hari2 ko absent or diorg leh proceed legal proceedings..

ape yg constitute misconduct?..kalu co dismiss ko sbb misconduct, diorg xleh amek ape2 legal proceedings...:pmuka:..katekan ko wat ape2 misconduct, co dpt tau, diorg dismiss ko, abes citer...

cume prob nyer cmne kalu co ko apply lps tu wat reference kat co ko wat prangai tu?...abes la record ko...

actually ... my previous co. pun mcm nih gak ... me is his precious .. pasal aku bawak masuk jobs ...
lepas letak notis ... dia offer naik pangkat lagi ... wekk ... tambah la beban kerja aku ...apa lagi .. aku tak letak harga lagi ... dia dah proposed gaji baru, tinggi gak .. malangnya aku sudah dilamar oleh co. yg lagi best

takpelah aku hilang 1    1/2   bulan gaji ... tp aku dpt 5 kali ganda dpd gaji baru masa tu ...

dlm masa yg sama .. ko buat jelah kerja mcm biasa kat opish lama ko tuh ... lepas letak 3 bulan notis ...

. notis ko dah letak
. keje mcm biasa
. gaji dapat .. tak kena potong
. dpt co. baru
. rekod tak buruk
. coolll ... tak kelam kabut ko nak handover kat org baru
. profesional la ek ?
. bos lama pon hormat kat keputusan ko

yg penting ko slow talk la ... kat co. baru
kalo ko memang best ... psati co. baru tu nak tunggu punye
tak pun ... kalo co baru nak ko gak ... dia kenalah bayar pampasan kat co. lama ko
mcm kawan aku buat jugak .... pengalaman kawan kawan ....
