Tussle over nasi dagang restaurant business settled


KUALA LUMPUR: The legal tussle between actress Sheila Rusly and her former business partner Datuk Azlina Che Abdullah over their nasi dagang restaurant business drew to a close after the High Court ruled that profits of the restaurant be split 57% and 43% respectively.

In a judgment read out by deputy registrar Hamidah Md Deril on Thursday, the court ordered Azlina to present all the accounts and records of Restoran Nasi Dagang House for the period between July 11 and Sept 30, 2005, for auditing within two weeks of the judgment.

He ordered that 57% of the profits to be distributed to Sheila, and 43% to Azlina, based on the capital investment of RM55,000 (by Sheila) and RM23,800 (by Azlina) respectively.

The court also ruled that the oral agreement between both parties had now been dissolved.

Further, the judgment which was made available to the press yesterday, also ordered Azlina to present all accounts and records of the new restaurant, Nasi Dagang Ulik Mayang, from Oct 1, 2005 up till Thursday, for auditing.

She was also ordered to pay Sheila all profits made during that period from the Nasi Dagang Ulik Mayang restaurant.

On Jan 21, 2006, Sheila had sued Azlina for breaching an oral agreement pertaining to the Restoran Nasi Dagang House, which served cuisine from the east coast.

In her statement of claim, Sheila said that in April 2005, she and Azlina agreed to open the restaurant business together.

According to the oral agreement, Sheila claimed that she was required to promote the restaurant business through television programmes and among artistes while Azlina was responsible for the recipe and main dishes to be served at the restaurant.

Restoran Nasi Dagang House, which opened on July 11, 2005, was in business for less than two months. Sheila is claiming her investment of RM55,000 and profits from Sept 1-Sept 30, 2005, loss of future income, general damages and other damages deemed fit by the court.

Azlina, in her statement of defence, claimed that the restaurant business failed because of Sheila’s failure to tend to the business when it was her turn to do so.

KUALA LUMPUR – Setelah lima tahun naik turun Mahkamah Tinggi di sini, pelakon dan produser Sheila Rusly lega apabila kes saman terhadap bekas rakan kongsinya, Datuk Azlina Che Abdullah akhirnya berpihak kepadanya.

Timbalan Pendaftar Mahkamah Tinggi, Hamidah Md. Deril dalam penghakimannya kelmarin membenarkan permohonan Sheila selaku plaintif supaya perjanjian perkongsian lisan berhubung restoran Nasi Dagang House dibatalkan.

Mahkamah juga memerintahkan Azlina yang dinamakan sebagai defendan mengemukakan kepada juruaudit segala rekod dan akaun perniagaan Nasi Dagang House (NDH) untuk tempoh 11 Julai 2005 hingga 30 September 2005.

Ia bertujuan menaksirkan untung rugi NDH dengan purata agihan untung 57 peratus kepada plaintif dan 43 peratus kepada defendan berasaskan purata modal yang dikeluarkan kedua-dua pihak iaitu RM55,000 oleh Sheila dan RM23,800 oleh Azlina.
