OPEN Letter and Appeal to the Home Affairs Minister


Should the Perak case on the legality of the new Menteri Besar appointed on 6th February be resolved by the Registrar of Society (ROS)?
Why ROS? This case can be viewed in the context of Hindraf which had only filed its application to the ROS for registration which was banned by the Homes Affairs Minister. (see the press statement below)
Similar (impression of the Minister) but worst worrisome developments have occurred in Perak except that there is an element of intervention by the Sultan there.
All registered societies including political parties must comply with Societies Act 1966 [Act 335]. All registered societies must comply with the Federal and State Constitutions [Article 2A] without exception except that the illegal BN Government would favour its own flock - the national fault line.
The powers of the ROS is stipulated in Article 3A in dealing with all registered societies and more specific in Article 7 (3).
The powers of the Minister is vested in Article 5 for public order and morality.
According to strings of statements in and out of Courts in Malaysia for a long time especially in Perak now, there is no doubt that BN component parties have committed enough Constitutional abuses of all sorts for the ROS to invoke its powers under the Act 335 to shorten the impasse of the rotten system with a glaring case in Perak..
Let this OPEN letter and appeal to the Home Affairs Minister be treated as a Police Report to ROS.

In a statement yesterday, Syed Hamid said the decision to declare Hindraf illegal was made as a result of investigations by the Registrar of Societies (ROS).
"The ministry found the organisation's activities contravened the Societies Act 1966 and if left unchecked, the organisation could pose a threat to public order, peace, security and morality in Malaysia," he said, adding that even the sovereignty of the country and prevailing racial harmony would be jeopardised.
He made the declaration based on powers vested under Section 5(1) of the Societies Act.
Syed Hamid said Hindraf had the criteria of an organisation as it had filed an application to register with the ROS on Oct 16 last year.
Despite not getting approval, he said Hindraf had been organising illegal assemblies and inciting hatred among Malays and Indians.
"Hindraf also tried to get the support of foreign countries to pressure the Government to bow to its demands," he said, adding that all these had affected the country's image.
