JK? Digest no 13 of September, 06 <227 of 2006> Malaysia Agreement - a review

ARE WE PREPARED FOR THIS?

Someone wrote a letter in the Daily Express about the Malaysia Agreement vis-a-vis the Federal Constitution. (DE 10th September 2006).

At the same time the retiring Sabah Commissioner of Police told Daily Express about the need of dimensional approach to resolve the most important challenge about the alien people in Sabah.

So it is timely that we form an Action Committee to review the Malaysia Agreement as far they affect Sabah and Sarawak - in legal, social, religious, economic and financial matters.

We are going 50 and these pertinent and pressing issues must be settled soon.

Any NGO and CASH included can be part of this effort.

Then we can consider the next steps forward.

fake Government

BN Does Not Want A 'Fake Govt', Dewan Rakyat Told

KUALA LUMPUR, March 29 (Bernama) -- The Barisan Nasional (BN) does not want to govern the country as a "fake government" by manipulating the election system as was done by some governments in other countries, the Dewan Rakyat was told.

"We don't do that in Malaysia. We govern the nation in accordance with the people's wish. Our government is a people's government, elected by the people, for the people," said Minister in the Prime Minister's Department Datuk Seri Mohamed Nazri Abdul Aziz when replying to M. Kulasegaran (DAP-Ipoh Barat).

Kulasegaran had alleged that there were weaknesses in the country's election system like in the postal votes which gave advantage to the ruling party.

Refuting the claim, Mohamed Nazri said Malaysia's electoral system was fair and did not favour the Barisan as evident from its defeat in Kelantan and Terengganu.

"It was under the present election process that we were defeated in Kelantan and Terengganu. In the 1999 general election, Barisan candidates lost because of postal votes but we accepted it.

"If this system has flaws or favoured the ruling party, then how this can happen? It should not be the case of when we win, everything is rosy, when we lose, the system is unfair," he said.

Earlier, when replying to Datuk Kamarudin Jaffar (PAS-Tumpat) who sought explanation on calls to revamp the Election Commission (EC), Nazri said the exercise was not necessary at the moment.

"The EC too is capable of running the election efficiently and effectively under the existing legal framework. In fact, Malaysia's electoral system has been recognised and accepted at international level," he said.

Nazri said that if there were minor shortcomings that needed to be changed, the EC could forward its proposals to the government for consideration.

On the proposal to use e-mail to make voter registration easier, he said the method would create more problems.

As to the suggestion to use thumbprints as proof that a voter had cast the ballot as was practised in India, Mohamed Nazri said the system was impractical as the number of voters in a constituency in Malaysia was not that many and could be controlled.

no MA

JK's Digest No. 21 of March 2007 (47 of 2007)- "A case for independence of Sabah - pros and cons"

This is the only positive move now in a book.

What is in your mind when I wrote that earlier?

Lets brainstorm a bit in the 21st Century of globalisation and era of knowledge.

Have we been blinded by some power seen and unseen?

You may think Sabah cannot leave/secede Malaysia?

Who say so? Where is the documentary proof?

Where is the Malaysia Agreement as valid?

Like 20 points were once considered seditious and sensitive,

and that was the deception. If 20 points were incorporated

in a public sort of legal document such as the

Malaysia Agreement signed in 1963, how can that be seditious?

So likewise when the Malaysia Agreement (MA) lapsed when

Singapore left Malaysia, where is the valid Agreement?

Like a business partnership, new agreement would be

needed when a new partner joins or leaves the partnership.

So we had been without a valid MA since 1965 unless

the Malaysian Government can present us with one now.

Is it in the Federal Constitution that Sabah cannot leave

Malaysia when the MA is null and void?

Whatever even marriage meant for life do get divorced - sad.

So when the noble intention of developing Sabah

as a less developed state in 1960s is not fulfilled

as observations are aplenty, then we need to

negotiate peacefully for a better deal or else

separation becomes inevitable.

So Sabah is entitled to compensation of all breaches

of MA and injustice since 1963 as per my claim

to the International Criminal Court of at least RM40 billions.

So the best start is a book to brainstorm our needs and direction in LA21.
