KUALA LUMPUR: Ahli Parlimen Pandan, Mohd Rafizi Ramli dihukum penjara 18 bulan oleh Mahkamah Sesyen hari ini bagi setiap pertuduhan memiliki dan mendedahkan satu halaman muka surat 98 Laporan Pengauditan 1Malaysia Development Berhad (1MDB).

Hakim Zulqarnain Hassan membuat keputusan itu selepas mendapati penjelasan Mohd Rafizi, 39, dalam keterangannya gagal menimbulkan keraguan munasabah di akhir kes pembelaan.

Zulqarnain memerintahkan hukuman penjara itu berjalan serentak hari ini. Dalam penghakiman, Zulqarnain berkata mahkamah mendapati tertuduh memiliki dan mendedahkan halaman 98 itu seperti yang dikemukakan dalam mahkamah sebelum ini.

Oktober lalu, Mohd Rafizi yang juga Naib Presiden dan Setiausaha Agung PKR memberi keterangan bertulis dari dalam kandang tertuduh. Mohd Rafizi didakwa memiliki tanpa kebenaran satu halaman muka surat 98 mengenai Laporan Pengauditan 1MDB yang merupakan kesalahan di bawah Akta Rahsia Rasmi 1972.

Dia didakwa melakukan kesalahan itu di lobi bangunan Parlimen, Jalan Parlimen, di sini pada 3 petang, 24 Mac lalu, mengikut Seksyen 8(1)(c)(iii) Akta Rahsia Rasmi 1972 dan boleh dihukum penjara hingga tujuh tahun, jika sabit kesalahan.

Bagi pertuduhan kedua, dia didakwa mendedahkan kandungan laporan tersebut dalam sidang media di tempat dan pada masa sama, 28 Mac lepas, mengikut Seksyen 8(1)(c)(iv) akta sama yang membawa hukuman penjara sehingga tujuh tahun, jika sabit kesalahan.

Bagaimanapun, mahkamah kemudian membenarkan penangguhan bagi membolehkan pihak pembelaan memfailkan rayuan.

A simple case of "Mati Katak"

Rafizi has been found guilty of breaking the OSA laws and sentenced to 18 months jail. This is no surprise as Rafizi himself had admitted to being guilty.
In a nut-shell, Rafizi got sentenced for deliberately breaking the OSA laws to expose "big secret", which is already known to the 5 Pakatan MPs in the PAC with full access to the OSA report, that LTAT had projects with 1MDB and had outstanding accounts receivables from at that time, which was since paid-up.
Rafizi has also been granted a stay of execution pending his appeal and will remain MP.

But this will disqualify him from seeking re-election until he gets a favourable outcome in his appeal.

He was not sentenced for "exposing 1MDB's monstrous scandal" as what Pakatan is claiming.

He was sentenced for being ill-advised in breaking the law for exposing one page of the 1MDB's Auditor General Report - which was already read by 5 Pakatan MPs including Tony Pua.

He had revealed the OSA document to "expose" that LTAT has links with 1MDB but has not been fully paid - something we all know already as news of LTAT being awarded the contract by 1MDB to move the Sg Besi air-base and to develop the 8 replacement military bases is public info.

In any case, LTAT has not lost any money and has been repaid by 1MDB and will be fully paid by the Bandar Malaysia project where the IWH-China Rail consortium has a 60% ownership.

Therefore, Rafizi's OSA "expose" is totally wasted and ill-advised.

LTAT lost no money at all and in fact, HAD MADE money and will continue to make money from the construction works of the military bases and from the contract to move the Sg Besi airbase.

This is the fourth straight court loss for various cases for Rafizi. Has anyone lost more court cases in a row?

He still has other court cases - civil and criminal pending.

His 4 years-old BAFIA case which is as clear cut as anything and also the LTAT, Tabung Haji and Najib-Rosmah (saya hanya bergurau) cincin cases to deal with, I can only say that Rafizi asked for this. And now he has got what he wanted.

This is an old image that I am re-posting to remind what happened earlier this year that let to Rafizi being sentenced to 18 months for breaking OSA laws.

“Saya tak kisah kalau dia (polis) nak reman (saya) lepas ini.

“Kami (Rafizi dan Arul kanda) boleh berbahas sebelah-sebelah sel, dan saya boleh dapatkan lebih banyak lagi maklumat,” katanya kepada pemberita di ibu pejabat polis (IPD) Dang Wangi hari ini.

Rafizi kelmarin nekad mendedahkan dokumen yang menurutnya tertakluk bawah OSA bagi membuktikan dakwaan kaitan 1MDB dengan Lembaga Tabung Angkatan Tentera (LTAT).

Dakwanya, kaitan itu mungkin menjejaskan keupayaan LTAT untuk membayar pampasan atau gratuiti kepada veteran tentera yang telah bersara."
