Utusan fails in appeal, ordered to pay Anwar RM200k

The Court of Appeal today dismissed an appeal by Umno-owned newspaper Utusan Malaysia which was ordered to pay RM200,000 to former opposition leader Anwar Ibrahim over a defamation suit.

However, the court ordered the interest to be charged from the date of judgment and not from the date of filing.

Court dismisses Utusan’s appeal, upholds RM200k award to Anwar

KUALA LUMPUR, May 25 — The Court of Appeal today upheld a previous decision by the High Court ordering the publisher of Utusan Malaysia to pay RM200,000 with interest to Datuk Seri Anwar Ibrahim in the former’s 2012 defamation suit.

A three-man panel at the appellate court also maintained the quantum of interest at 5 per cent but ordered it to be charged from the date of the High Court judgment last year and not from the date the suit was filed in January 2012.

“As far as the assessment of damages is concern I am going to dismiss this appeal.... save and except for the order of interest, and we order the interest to run from the date of judgement.

“We just change from when it runs,” Justice Datuk Dr Prasad Sandosham Abraham told the court.

Other judges on the panel today include Datuk Zabariah Mohd Yusof and Datuk Asmabi Mohamad.

The court also ordered Utusan Malaysia to pay RM5,000 in costs.

Anwar had in January 2012 filed a RM50 million defamation suit against Utusan Melayu (M) Sdn Bhd and its editor-in-chief Datuk Abdul Aziz Ishak for publishing two articles on his comments to British broadcaster BBC during an interview on homosexuality laws.

In January 2013, he won the defamation suit, with then Kuala Lumpur High Court judge Datuk V.T. Singham ordering RM45,000 in costs to be paid to the former Opposition Leader, while the damages were to be assessed at a later date.

In October last year, High Court judge Justice Hue Siew Kheng ordered RM100,000 in general damages and another RM100,000 in aggravated damages to be paid to Anwar. Utusan was also ordered to pay RM8,000 in costs.

In his submission today, Utusan Melayu’s counsel Wan Azmir Wan Majid argued that Justice Hue had erred in her decision as she had not taken into consideration Anwar’s past convictions when determining the sum of damages to be paid to the politician.

Anwar’s lawyer Latheefa Koya interjected, saying the matter had been raised and that Hue had merely adhered to the Court of Appeal’s ruling in Anwar’s previous defamation suit against Datuk Seri S. Nallakaruppan and two others, where the respondents were ordered to stop relying on the jailed opposition leader’s criminal convictions to attack his character.

Prasad agreed to the point and proceeded to make the ruling.
