hasribus, like it or not, you've signed the offer letter so no escape. Anyway, ada solution - some of the solutions :

1. negotiate with current employer to serve 3months then till they find a replacement buat handover then you are out, ni make sure semua ada dlm aceptance of resignation letter, make sure ada black and white.
2. negotiate for 2 months notice, 1 month minta employer waive notice - your future employer can wait if they really need you.
3.negotiate that you serve serve 1 month, waive 1 month or less, dengan offset whatever annual leave you have and pay one month - get the future employer to pay the notice in lieu.

Explain la kat your future employer, you need to serve 3 months notice, and get them to pay or wait for you,this will show that you have responsibility and credibility and of course as employers, depa pun taknak employ employees yg takde credibility - serve notice half way pastuh lari, that sort of things.

Jangan buat perangai, nanti blacklisted susah. Rey dulu pun 3 months notice gak, I served 1.5months, till my replacement masuk, handover and the rest of the notice my future employer yg bayar:love:

setahu aku... kalau kena terminate sebab masalah disiplin dorang takkan bayar apa-apa... kalau report pejabat buruh pun ko tak leh menang sebab ko kena terminate atas dasar masalah disiplin...

kalo kena terminate because of disciplinary,gaji akan dibayar right till the last working day, gaji je yg dibayar, all other benefits eg. bonus, annual leave balance, etc takkan dibayar, it will be forfeited. Tapi kalo terminate based on disciplinary, panjang skit process, coz bukan senang, the process involves investigation, domestic inquiry, show cause letter etc etc. Process kena btul, if not employee boleh file complain for wrongful termination.

But, if the misconduct is a major misconduct - that means yg very factual and company ada hard evidence on the spot leh kena terminate, itu pun after employee berkenaan jawab show cause letter and admit the mistake - so up to management to kenakan tindakan or terminate terus.

tgk gak kompeni tu....mcm tmpt aku kalo nak benti sebulan je letak surat..........kalo letak awal mcm seminggu sebelom belah memang gaji bulan yg keje tu x dpt..........tgk tempat la...........

kalo letak resignation letter, lepas tu from the date of the letter kata nak blah within a week, of course la company hold gaji, sebab by right you have to give katalah one month notice ( or 3 months or 2 weeks, based on offer letter), sebabnye kena hold or tak dapat gaji langsung is because company akan contra balik whatever gaji that you earned dgn notice yg tak cukup tu.

So, if nak resign, refer balik kat offer letter yang you all dah sign, check on notice of termination, kalo nak resign braper lama notice kena bagi and then counter check balik your employment status,dah confirm ke belum, some company sama je dah confirm ke belum confirm ke, duration of notice is the same, setengah company sebelum confirm notice is less than after confirm:jeling:

me plak after dpt keje baru of course kene tender 1 month notice. bos tempat keje baru tu (my bos now) dah desperate giler nak pkai org, ask me to cabut jek. but haku ni kesian ngan superior aku coz dier ni chinese girl tp very the baik, so aku tender surat minta pelepasan awal - 2 minggu (tindakan bodoh la aku rasa sedangkan aku tau bos lama aku tu very the wicked lady). sekali admin btau yg bos lama aku suh hold gaji if aku benti before cukup 1 month notice. then they will deduct my salary berdasarkan balance setengah bulan yg aku benti tu.

so, to avoid gaji aku kene hold n kene deduct, aku ckp ngan kakak admin tu yg aku cancel 2 weeks notice n replaced by 1 month notice. so selamat lah gaji aku tak kene hold. 5 days after kejadian tu dah gaji, tengahari aku gi withdraw gaji then aku terus tak masuk keje... muahaha :nana:

dlm 2 weeks after that aku dpt surat dari company aku, suh aku pulangkan harta company klau aku ada amik, (harta company yg ada pd aku cume access card jek) n bayar company the balance yg aku dah benti tu. aku handed over access card tu pada kawan aku jek.. yg duit gaji aku diorang suh byr balik tu, TAKDE MAKNENYE haku nak kasi!! :pmuka:
